Capital One Violations

This company is amazingly crooked. Smiley Mad  They re-aged accounts in 2006 from 2003 to 2004. I have been disputing back & forth.  My credit file with Equifax dropped off the account its aged. TransUnion dropped one but the other is scheduled to drop in 01/10. Lastly Experian 2 accounts same drop off date 11/2010. Three bureaus with three different information for the "SAME" 2 accounts from Cap 1. I wrote them & sent them copies asking them to provide me with documentation, they refuse, they refused original contracts, a breakdown of what they say I owe..They refused everything, yet they verify the debt as valid. In February '09 after years & months of the Capital One run around I contacted the BBB,OCC, FTC, Fl. Dept of Consumer Services and the AG.  They once again verified the debt as valid and did not provide documentation as to the differences in the 3 files.  To makes matters worst, they retaliated against me in Feb. 09 modifying coding on the accounts to make them appear as they had been recently charged off..I.e.. Instead of 07/04 CO date, they now show a charge off for every month on these accounts have modified the reported/status dates, and are making the two appear as key  derogatory when they are about 7 years old.  The funny thing is I have copies of correspondence from them to the BBB and copies of all correspondence, green cards, credit reports from 06. Comparison of credit report discrepancies for same accounts. I have sent this to the OCC, Federal Reserve, Va. AG, Fl. Dept. Of Consumer Services.  They are maliciously and with intent violating my rights under Federal Consumer Protection Laws. Including not indicating that I have been disputing the 2 accounts since 2006.  I am going to see an attorney & see if he can sue these jerks for continuously running my life.  I would appreciate additional suggestions/advice.  Thanks.

Filed Chapter 13 April 2012. Case successfully closed May 2017, about 1 month after 60th payment. FAKO scores on close date: TU 695 EQ 697. Received discharge July 11th - took forever! Real EX day of discharge 624.

Ever time that an OC or CA reports does not re-age an account. It only updates. ( report date)

 

The CO date means nothing. baddies delete 7-7.5 years from DOFD.

 

a drop off date 11/2010 means the DOFD was 11/2003

Hang in there. You have my sympathy and my confidence that yes, you can wear the capone out. I think the attorney may be the way to go.

The charge off date and reported date don't mean anything in terms of when the account will be deleted. The only thing that matters is that your DOFD. The account will disappear 7-7.5 years from this date.

 

Keep in mind that if you dispute an account, write a letter, or anything of that nature the account will be re-reported with an updated date and will more than likely cause your score to drop because it will appear the account is recent. 

 

Try not to wake sleeping giants if they are about to die.

Thank you. The issue was they dropped off Equifax. One dropped off TransUnion and the other is scheduled to drop off 1/2010.

 

Experian has totally different dates. Capital One was sent copies of old reports and they still validate as correct. I reported them to the OCC & FTC and sent documentation as to the discrepancies...Nothing will probably come of it. They are total jerks.  They have even failed to indicate I am disputing it.

wow...I can't believe you had the same problem I recently had with capital one...I got a bill that cut june 20th and received it june 27th..I was going on vacation so i paid it that day on line..it wasn't due until july 15th..so it didn't show a payment in july but I paid it  immediately and I emailed them to correct...they said it was an error but then copy and pasted some response that theycannot remove it from my credit report..I got to a high up person in the company..and got an apology and said I should have waited until july to pay and not pay a bill when it comes in and have a month show no payment.I have contacted the BBB but capital one basically said they didn't care if I did..

I have heard this from many people.I am shocked at them..the credit reporting agencies all say this is wrong but since capital one keeps saying it is valid there is nothing they can do..other than legal action..I just contacted the BBB rather than paying an attorney for something like this..the BBB said they get many complaints on capital one..I am surprised..this is the only problem I ever had..wouldn't expect it from a company like that..but I guess there is a first for everything.
