It seems as though she has had a Cap One account for a while. She missed one payment by 5 days, and it is showing as a 30 day late on her credit report. She contacted the EO to get a good will adjustment and they told her that she's asking them to report fraudulently as they are required to report accurately. She was a nurse's aide, went back to school, got her nursing degree and had a brief but serious financial hardship. So, she feels that good customer service would look at her over all history and remove the one late she ever had, but they instead were unpleasant to her.

Quite frankly, I would also be irritated. Was she wrong for missing a payment? Sure. Is she asking for a favor? Yup. Should it be granted? Yes, I think it should be. Creditors do this all the time. She isn't in the habit of it, and it wasn't a 60-90-120 day late, it was late by 5 days. Does she have a right to be miffed that they refuse to help? Yes, I think so. Again, it was 5 days.. hardly a reason to tank her credit score 40 points.
As others have said, if it was just 5 days late, it shouldn't have been reported anyway.

If this is in fact true the reporting of a 30 day late is in error, if they refuse to report it as OK pays as agreed file a complaint with the CFPB.

If you were truly only 5 days late and they are reporting as 30 days late, that is fradulent reporting and is in violation of the FCRA.

This may be artistic license! GE also reported 30 days late, so there may well have been 30 day late on Cap One.
Someone made the analogy that if you lent a person money and they paid you back 5 years late..... So "5 days not 5 years" may be a reference to that rather than being an actual lateness of just 5 days.

I am making an analogy to show that it is easy for us to expect these credit card companies to be so forgiving but I don't think many of us would do the same with our own money. As far as not taking responsibility I am talking about expecting these companies to remove accurate lates and getting mad and slamming them if they do not. I have a 30 day late from Cap One and I have tried a million times to have it removed and they won't budge. Does that suck? Yes. Am I pissed at them about it? No, it was my fault.
Capital One is not Amex, they are dealing with customers with overall riskier credit profiles. In order to profit from these customers they have to approach things a little differently than Amex would. For example, I had an account charged off in 2003 and didn't pay them a dime for 5 years. I finally paid it off and within 6 months they gave me a new unsecured card (middle of 2008 no less). No way Amex would have done that.
I want my credit card companies to make money. More money for them equals better rewards, lower APRs and higher limits for me. Capital One has decided that removing accurate negative account info is not in their best interests and I'm ok with that even though it negatively affects me personally. I just don't understand the negativity aimed at so many of these companies. To me it seems that most of the time it boils down to someone mad because they didn't get their way.
