Charged off account not showing on CR

There was a First Financial Bank account that was opened in my name by a family member in 1996,
without my permission, and I never paid it. The debt was written off in 2003, and not showing on my credit report since then. Today I am getting a collection letter from a Law Office trying to collect on the debt. What should I do? Should I just wait until the sol has expired? Can this be added back to my credit reports now if I do not respond? Please help!

A CA can still engage in collection activities even if the 7 yrs for CRTP expired and SOL expired. They just can't sue.

Re: Charged off account not showing on CR

This is a credit card account. I have an old Experian cr that says dos is 11/98 and the last reported date is 9/03. I never filed a police report and my sol is 7 years.

To be clear, they can still sue if they are outside of SOL, and if you don't show up, they will get a default judgment.  If you do show up, however, you have SOL statutes as an affirmative defense.

The SOL statutes don't prevent them from suing.  They just prevent them from winning, IF you are there to fight it.

Re: Charged off account not showing on CR

ok that was 5 years ago........is it typed in anywhere     will remain on CR until month/year??  Does it show or tell date of first default?

SOL is 6 years       I would send a DV    do not sign it just type your name.

send it CMRRR  to the name and address from the letter.
