Checking account- charge off

Hi all, I am coming out of obsessive lurkdom to ask a question.

I have a credit union checking account and a regular bank checking account. I rarely use the CU account. A few months ago someone wrote me a $2,100 bad check which over drew the CU account and it has remained overdrawn since because, just my luck, the person who wrote me the check has skipped town. I contacted the CU to tell them that I am expecting my tax refund and will be at the bank to deposit as soon as I have it. I finally received my return and went to the bank on Sat. they would not deposit the IRS check because it is in my husbands and my name (he is not on the account). He signed the check but they say they can’t verify signature. Their hours suck, so we can’t go back together until tomorrow. Now today I pull my CR and I have a $2100 charge off as of May 2008 with them for this checking account WTF!! Now what? Do I ask them to agree to delete when I deposit?

Thanks for your advice. I have really been working hard on my credit and now this….

First, I would call the police and file a police report. I'd also give a copy to the bank. They should be able to cover that without incident and remove it off your CR. Also ask them why they covered a $2100 check with no funds.
 
If you opt for a PFD, get it in writing. Include the 3 CRAs AND be sure to include Chexsystems as it is probably on there too.

Thanks for your reply. I thought about a police report, it was a “friend” that had wrote the check to my husbands business for payment of services. We were hoping he would soon pay up.

I wondered about the CU making the funds available to me also- they held the check for 4 days, so I am completely confused on that one. It is the only transaction that I made for that month.

Thanks for reminding me about Chexsystems, I didn’t think about them.

Reason I mentioned a police report is because with that you'd have the option to dispute. From what I have read, EQ  is very receptive in removing a baddie if you send them a copy of the report (I assume EQ...most CUs use them). If you dispute without it, it will only get verified and it will be harder to remove in the future.

Friend or no friend.......they kinda screwed you over and you have to look out for urself.....I think the debt will look more valid if a police report is attached to the dispute with the bank or even presented to the bank when talking about a PFD

To my knowledge, a police report sent to the CRA will do no good. That only works when it is ID theft. This is not the case.
 
The only thing I see for you to do is get a PFD from the CU and then file in small claims court with your local court or turn the check over to the prosecuter to prosecute for "passing a bad check".
 
You need to get the check back from the CU so you have proof.
 
I would speak to someone at the CU and explain that when the released the funds after 4 days, you believe the check was good, so you withdrew the money. Ask them if they'll remove the information from your report if you pay it off in full. Mention that you kept in touch with them and let them know when you'd be there to pay for it.

Thanks for all the advice. I spoke to a supervisor at the CU and she said as soon as I bring the account positive they will remove the info from my CR. I asked her to fax me confirmation letter. I PIF on Saturday and I will be calling to follow-up today. Hopefully all goes well!

Just wanted to take the time say - thanks to all those who are so helpful on these boards. So many people are becoming more debt and credit savvy because of this! I know I read and learn every single day.
