Child Support?

In a case where a county reports a arrears balance the the credit agency's, does that go on as a public record? They also state that they will udpate it with balance changes, but if I pay the balance to $0, the item will still remain on my report for the 7-10 years? This will hurt the fico score right?

I hope you get this arrears taken care of, not only for the sake of your credit, but for the sake of the involved child.

Re: Child Support?

Yeah thanks for the link. I am asking because I am only $640 in arrears and there cut off is $600 and I told them I could pay half now and half next month. They told me I had to "pay it all" in full by Dec 28th or It would go on my credit report. Partial payments wouldnt stop it, even if its below there 3 times the monthly amount criteria..... that sucks

Re: Child Support?

hi matt,

As far as I know, child support seems to be an entity of it's own and not subject to standard reporting timeframes.  It's totally in your best interest to do anything possible to catch it before there is a chance it gets on your CBRs.  Once it's on it can become a total nightmare.

Any possible way you can BT some cash from a cc into your checking account?  Anything you can do now... extra hours, borrowing... selling DVDs to one of those stores... sell some junk on craigslist etc.

I don't want to encourage you getting into any debt with the BT but if you know you can handle that within a few months, grab it while you have the opportunity.

G'luck!

Re: Child Support?

From my personal experiences with CS, there are certain factors that are highly important. First off, is the CS receiving parent receiving state assistance? If they are, then their is no way of getting out of paying the full amount. If not then you go to your county court house and enter a motion for depletion of arrears. As long as th receiver agrees to this ( Im quite sure they will once you explain that you are trying to clean up your credit) you go to court and the judge will enter the motion to do so. This takes about 3-5 days to post to your CS account. You will still owe any intrest accumilated on the account (about 5% of total arrearage) Once this info is filed with CS they will notify what ever CB that they have reported to that the account has been paid in about 6 to 8 weeks. But doing it this way keeps it in your report, this will hurt your score. Instead after the judgement has been passed and is posted to your CS account enter a letter of dispute about the info to the CB it has reported to stating that the account is null and void and you would like to have the deragatory statement removed. The CB will check with the CS agency and shortly there after the info will be removed. This may very well boost your score 35-45 points. I know because I have done it before. This is also info that I received from an employee at CS services. (In ohio, other states may differ) Remember all unvarifiable negative info must be removed from your report.....
So pretty much if its on your report as owed and you say no, when they check to see if its owed and its not owed according to CS it must be removed.

Good luck & GOD Bless

Re: Child Support?

check ur state laws. If its under a certain amount..some states dont report. SOME child suport ppl will tell u anything just so u will pay (and might be a bit bitter due to them or someone they know is not getting the support they need). Im going through a thing with them now in my state with another state trying to collect for the same child..but im paying through my state. So please read up on ur state laws and just pay it as soon as possible. The judge didnt tell u how much u have to pay per month/week and what part of that is going towards the arrears?

Re: Child Support?

In this case, if what they said is true, I'd try a quick payday loan for the balance if that's your only option.  Anything to keep it off your report!

Re: Child Support?

Yeah I contacted the county and they told me they have nothing to do with the reporting, its the state.
Also my monthly support is $200 and there critera is 3 times the amount. Well when I called in my balance as of now is $579, so from the 8th it went down from $637-579. They gave me until the 29th to pay it in full. I called the state to tell them that my case does not meet the critera and see what they are going to say. I am also worried that even if I pay it, it still might get added to the CB by mistake, and then its going to be a nightmare getting it removed when it should have never gone on there in the first place. The lady told me that it could happen becuase of the way the CB computers and the State computers update and communicate. She told me that if it gets put on there by mistake I have to dispute it with all 3 CB, the state cant fix it.

Its my understanding that if the arrears is valid and gets put on the CB, even if the amount gets paid then, it will remain on my report for 7 years. Hence hurting my score.

Thats bull...Why cant they fix something THEY report and WOULD verify if you dispute it with the CRA's? I would pay this in person and have them write out on one of their letterhead's that as of this date (the day you paid it off..or you might want to leave a date off) the balance is $0 and the debt is satisfifed with our office (or something to that effect ) and have it handy so you can dispute it later with the Child support office and the CRA's if it comes down to it.

Re: Child Support?

You have to keep in mind that the child support system is one of the prime examples of how America has moved from republic to empire.

The child support agencies are, for all intents and purposes, above the law. The Constitution doesn't apply to them. Once they get their claws into you, you've got about as much legal recourse as a Gitmo detainee. You might as well be an "enemy combatant."
