Collection Agencies and Credit Reports

Can a collection agency pull your credit report without your consent or knowledge? I've been trying to deal with these guys for the past month and they've been unwilling to work with me. Suddenly, they call my wife when I'm not at home and demand to know who's been making our car payment since we can't pay them the 2500 dollars they want. They then proceeded to call her back every 2-3 minutes for about a half an hour before (and I have no clue why) calling my parents (who I haven't lived with for 11 years) and harassing them as well. I checked my credit report, and sure enough...they'd tapped my credit. Is this legal? I keep trying to find something about it in the Fair Credit Reporting Act but with no success.

For a hard pull of CR  they need PP....we all disagree if a CA has PP...I say NO!

Are you sure it is a hard pull?

What they are doing is illegal!!!!!!!  do any of you have caller ID??

Need more info. on CA...who  dates??  is this a CO  dates

IF they call again when you are there...tell them
*by law I have to say this*  oh what was your name again  (ans. joe blow)  well joe blow...I want you to know that  this call is being recorded!!!!  NOW I am telling you that you are not to call this phone # or any friends or family's #........If you do I will I WILL file suit against you!  HANG UP!!!!!

Read this by NOAH     and file a complaint at www.ftc.gov

If they keep calling I would file a complaint with the police & call the AGs office.

Re: Collection Agencies and Credit Reports

Just an update: I'm not sure how to tell if it's a hard pull. Any information in that regard would be appreciated. Four times I've spoken with these clowns and four times they've refused to take what I can pay them. Of course I get the standard drivel about taking me to court if I don't pay them within 24 hours, ect.. but what takes the cake is that they're calling everyone in my family and in my wife's family now and making threatening and harassing phone calls. I take this as a personal insult and crossing WAY over the line to perform these stunts. What kind of legal action can I take against these knuckleheads since they seem intent on trying to harass everyone we've ever known? Creditors Financial Group www.creditorsfinancialgroup.com

You can start by sending them a letter CMRR telling them at all communication must be in writing.  They must comply with that.  Not sure if you can DV at this stage, but others on this site will be able to advise on that.  Also, you should file a complaint with the proper agencies (FCC or FTC I can never get those two right).

Send them a DV letter and add Do not call my home, family or friends! All phones have caller ID and all calls are being recorded! If the calls continue I will File a law suit  useing all the state & federal laws that you are breaking!

If the call hang up!   send the DV  CMRRR  Never talk to them on the phone.

They have violated federal & maybe state laws.  What is the SOL on this debt?

You can also call the AGs office and tell them that you are being harrassed by the CA.

Also find out what the state law is for recording the conversations. The Federal law is  1 person must ok it....you are that person. Your state law might be different. What state are you in?

Re: Collection Agencies and Credit Reports

Not sure what all the abbreviations are so would love some clarification about that. Also, I'm in Georgia. I just filed a complaint with the FTC so I'll cross my fingers. Your abbreviations remind me how people must have looked at me when I was in the military and sitting at a McDonalds with a friend discussing a field exercise =)
