From what I've read, if you DV and they validate you should be ready to pay b/c a summons usually follows. But I don't know how true it is. I'd say it would depend upon how much the debt is as to whether a summons follows. Once you DV and they validate you can't get into court and pretend you weren't aware of the debt or that the debt is not yours. They done have all the information they need and have provided you with it, if they validate.



Sorry to hijack you're thread, but I wanted to ask a question about what someone responded to you.

I thought as long as the debt is outside the SOL that they cannot summons you? If I DV a CA, will all the other CAs see that and start contacting me? Or will the others just contact me after I contact them? Aall but one of my debts are outside of the SOL - that one has 1 more month then it's off!

If they have NOT already started legal action and you DV they cannot start legal action until they validate.  "Legal action" is considered collection activity per FTC opinion letter.  Will they is anohter question - and it could be 'stayed' until they validate.  My suggestion if that happens is to ask for a 30 day stay during which they must validate the debt. If they fail to validate then a dismissal with prejudice is in order.

Sorry for jumping in, but I am really new at this. What does it mean to DV? And then what good does that do?

I have just dealt with 2 collections on a credit report that I was working on for my mom.  It was in December 2007 with West Asset Management.  It was a hospital bill that her insurance was supposed to pay but they did not and she was left to pay the bill.  We had made arrangements to pay it in I believe February of 2007 making payments and then in December 2007 she wanted it paid off.  I called the company and they said as you want to pay the bill off we can accept 75% of the money and it will not hurt your credit.  Well now she has a medical collection on her report and I have no idea how to rectify it.  She also has a silly $75.00 collection for a medical bill also on her report that was also supposed to be paid by the insurance company but they did not and she paid it.  They also put the collection on her reports.  She has nothing else derogatory on her report.  She has paid her bills on time for 25 years and never missed a payment.  I called both the collection agency's and the West Asset Management people were nasty and rude.  The NCO Financial were very nice but told me they could not remove this from her credit report.  I hope you have better luck with them.  I am hoping there is someone reading this that can give me some ideas.  thanks.
