Collection on my CR that's not mine,,,

Hi all, Problem. A few months ago Cavarly Portfolio called me up and wanted money for a collection account that wasn't mine: it's my father's. Let me point out I'm married and we don't live together. I explained this to them, to which they responded, "OK." Fast forward to today, when I checked my Equifax CR, and it's now on there!! How do I get this off, and do I have any legal options?

They contacted you by phone and sent nothing in the mail to you?
If this is the case- sue them for a FDCPA violation

If they did send a letter- Send a DV letter CMRRR within 30 days.

Don't say anything about this being your father-

I didn't receive a letter at all. I was shocked that they even found me (we do have the same first and last name, but different middle name's). Would it be smart to call them up and flip out? I definitely did not receive a letter from them.

Re: Collection on my CR that's not mine,,,

As an update:

I called Cavalry this AM. I refused to give them my SS number, so they did a name search. Big surprise, come to find out, it isn't me who they're looking for. I asked how they got my information, to which he responded, "we searched CR's matching your name and found your number."
So, basically, they pulled my credit without authorization,
I was also told I have to file a claim with Equifax to get them to remove it, because it was Equifax's error, as the SS numbers didn't match up.
Is it my responsibility to now argue this with EF? DO I have any options? I'm none too pleased that they've pulled my credit over this.

DV the CA - FULL MEDIA.  And no, you should not have to fight with equifax - since someone there has admitted an error they should correct their own mistake.  do a DV (and since you can prove error) an ITS to the CA for their reporting error.  At the same time - file with state AGs and FTC.

Re: Collection on my CR that's not mine,,,

This reminds me of a letter I recently opened for DH.

It was from a CA and at the bottom of the letter, it added the fact that part of his social was x'd out since  "more than one person in the world may have the same name"  Go figure.
