Credit Report

I am not sure what i am doing wrong but I was recently denied for credit and per the letter the lender sent me, it stated that i am entitled to a free copy of my credit report. I have sent off 3 letters, 1 for Experian, Equifax and TransUnion. Along with the letter, I sent a copy of the denial letter from the lender and a copy of my DL and SSN card. This was 2 months ago and I am not sure who to contact in order to get assistance. I call the phone number but i get a recording on how to order my free copy of my report does anyone else have any suggestions.

You have complied with the requirements of FCRA 615(a) by providing them a copy of the adverse action and your written request for the free copy.

The free copy provision is further detalied in section 612(b), requiring that the request by the consumer be made within 60 days of receipt of the notice of adverse action.

I assume you sent within 60 days.

 

However, unfortunately, no specific time period is specified for the CRA to comply.

When statute makes a requirement on a party with no specific period for compliance, then a reasonableness standard kicks in.

If you feel that their delay has become unreasonable, and two months is, in my opinion, bordering reasonableness, then you can send them a notice that you consider them in violation of the provisions of FCRA 615 as supplemented by section 612(b).  I would inform them that you will file a complaint with the FTC for their violation if response is not recevied with a week.

The only problem is that I don't have copies of the letters that I sent them. All I have is the original letter sent to me by the lender. Should I re-send my request via certified return receipt and if I don't get a response then inform them of their violation of the FRCA?

I used to get free reports after being declined by digging through their website and ordering online via their FACTA notice. I know they really bury their links now and it's much harder vs. 3-4 yrs ago. I recall looking for the same links for another poster who asked a similar question and only found 2 of the 3. But they are in there some where. Anyway, I'd restart with a new request and see what they say. If they say that time is up you can always send a fresh round of letters CMRRR with copies of the certified mail info to at least demonstrate you mailed them. Don't send them any letter saying they violated the FCRA unless you have proof that you sent something.
