I have an Nissan account from a car repo - repo occurred about 2/2005 - so I'm happily anticipating it's removal soon. HOWEVER, EQ has the DOFD as the date I filed Bankruptcy - 10/2005. WRONG!
I disputed and it came back verified.
What do I do now?

Do you have older CR's from EQ, that have the correct date on them? If so, send EQ copies of CR with the correct DOFD as proof.

I do not have an older credit report w/ a different date.
Are there any lates showing prior to the BK?
Does the repo comment show at all?

This is what MYFICO shows it as. EX says it will drop 2/2012 and TU says 3/2012. According to what I can decipher here, it won't be until October 2012 and that's WRONG - it could even be 6 months after that. Maybe a DV letter to Nissan themselves and a little side-note that they have the DOFD wrong on EQ??

PS: This is the only account (besides a student loan) that is showing w/ the red flag that isn't a collection.
The except above doesn't include a DOFD, only a DOLA. Two different dates. DOFD always preceeds DOLA. I think if you pull your report from annualcreditreport or directly from Equifax.com, you should see a listed DOFD.
The red flag is due to the IIB comment, which is a negative.
The DOFD from EQ says 10/2005 as the DOFD.
I dont understand why DOFD is even an issue on this account.
DOFD is only relevant to charge-offs and collections, pursuant to FCRA 605(a)(4), 605(c), and 623(a)(5).
The actual reporting of a DOFD is governed by FCRA 623(a)(5). and is not even required to be provided to the CRA until the delinquent accout has been charged-off or referred for collection. They then have 90 days from that date to provode the DOFD to the CRA.
There is no requirement that it otherwise be reported.
A repo, if reported as such, is not a specific item of adverse information listed under one of the paragraphs of FCRA 605(a), and thus falls under the coverage of FCRA 605(a)(5) as "any other item of information." The credit report exclusion date is based, per section 605(a)(5), on the date of occurence of the adverse item, and terminates 7 years thereafter. DOFD is not the issue.
