Debt validation & PFD letters

If I use my credit report and take all of the collections and charged off accounts can I send DV letters-I have previous ignored letters and calls from CA because I didn't have the means to pay on the accounts.  Now I do and would like to do something but want to make sure I'm doing the right thing by sending DV and once recieved back send PFD?

Thanks

Re: Debt validation & PFD letters

Concurrently send the DVs and dispute each CRA. If they verify, and you agree, send PFDs. It should take you about 60 days to complete all of this.

BE mindful of SOL. Stirring a nest of sleeping hornets may have undesirable consequences.

Re: Debt validation & PFD letters

Personally, from reading the FCRA - I would save 'my' dispute with the CRA.  The CA is required to notify the CRA that you are disputing (violation if they don't) so my personal opinion to to let them do it or rack up a violation against them.  Am I setting them up - you betcha!

Re: Debt validation & PFD letters

Are you saying to send DV to the Credit Reporting Agencies not the Collection Agencies?

Re: Debt validation & PFD letters

I think they are telling you to dv the ca, and that the ca will have to notify the cra that you're disputing anyways,  and not to dispute with the cra until the 30 days are up from the dv, so you can send the green card and copy of your request of the dv to the cra to show that they failed to dv within the 30 day window .  did i summarize this correctly?

Re: Debt validation & PFD letters

You DV the CAs and dispute the CRAs. Two trains of thought: DV the CA and wait to dispute the CRAs for a later date or DV the CA and dispute the CRAs at the same time. I prefer the later becuase it worked for me. YMMV.

I don't think a CRA cares if you dispute or not with a CA. I don't think sending them a copy of the letter helps any.

A CA doesn't have to validate within the 30 day window...they have an unlimited time frame. However, a CRA has 30 days.

Re: Debt validation & PFD letters

Before doing anything  know your SOL. At times there are things on your CR that is past SOL.

If past SOL they can not sue you. Also it is easier to get a PFD accepted.

Never PFD or pay any CA  without DV  first.

Be sure that the CA is licensed in your state IF the state requires it!!!!

IMO  never dispute until after the 30 day DV time has past and they did not answer.  It will come back verified!

Re: Debt validation & PFD letters

And if they verify the debt without having validated - they have a nice violation on their hands!

Re: Debt validation & PFD letters

I was going to start the same thread so I am so glad to see this. I thought 100% SOL for Pennsylvania was 7 years. Now I found out it is 4 years. MOST COLLECTIONS on my report are past the 4 years! I don't remember seeing letters from CA's because I think my wife has always thrown away. We had no idea of our rights  and it is a godsend to find fico and you fellow credit supporters. So with that said I also have a Q: Can I send DV's to all CA's on my report or do I have to wait till I see one of those debt collection bills they send to me?

Re: Debt validation & PFD letters

bott SOL and the time it can report on CRs is 2 different things.

SOL is how long they have to sue you (and get a judgement) - it has nothing to do with how long it reports.
