Derog comments from BK. How long do they stay?

Looking over my credit reports, I have some accounts that were closed 6 years ago in my CH 7 BK.  As a result, they have derog comments such as this;

TransUnion]     [Experian] Debt included in or discharged through Bankruptcy Chapter 7, 11, or 12.   [Equifax]

So, anyone have an idea how long these derog accounts will be reported?  They've all been closed since summer of 2001. I have hopes that they will go away next year, but do I need to dispute them?

Which report/s are you looking at?  Mine have a date that shows when they are going to fall off my report and I believe take the derog comments with them?

I could be wrong, but I have one coming off in August then I could tell if the comments are gone.  I think that whole TL gets deleted though?

I'm looking at the reports that I pulled here on the MyFICO site and checking them closer on the hard copies I have printed out and keep in my briefcase (I know, I'm sick with this credit history cleaning bug).  The TL's show things like date opened, date closed and date of last payment. Then they also show the comments I described earlier (Derogs).  It seems to me that I do remember seeing the dates you mentioned, but I believe they may have been on the copies of my CR that were sent to me when I was denied in my attempt to get something fixed on my report.  I'll have to see if I still have them.  I have been thinking that any TL that hasn't had any activity for 7 years would stop being reported. I just wasn't sure if maybe they would stick around because of the comment linking it to a BK.

Re: Derog comments from BK. How long do they stay?

Kev,

I pulled out my EX credit report and it does have the date that the account will be removed.  I have one that has already been removed, meaning that it is deleted and all derog comments with it.  I have several accounts that are part of my BK7 2001 that are dropping off next year:

April 08  -  3 accts
May 08  -  1 acct
Oct 08 -    2 accts

These will all drop off as they are at their 7 year reporting limit.

Hope this helps you.

Sounds like you and I are pretty much in the same boat. All of my remaining baddies (except the BK itself of course) should drop off next year starting in May.  I can't wait.  This has all turned into some sort of twisted game for me. Seeing how high I can actually get my scores to go after a BK.  Considering I had super credit (didn't know my scores) before the BK, I hope to hit the high 700s.

You will, just keep doing what you are doing and don't get any new lates, collections and pay everything on time or before time and we will both be doing great.  I have one other major baddie that I need to get off so I am going to file a motion in court for it and see if the judge will dismiss it altogether because it was discharged in my bankruptcy and I have some lates that I have gw'd but gotten no response on.  Anyway, time will tell, right?

Re: Derog comments from BK. How long do they stay?

BK info can by law appear for up to 10 years. FCRA makes no distinction between BK7 and BK13.

In practice, the CRAs appear to report BK7 info for the full 10 years, but BK13s tend to drop after 7 years. Sometimes sooner.

The law also appears to permit a BK to report either from the filing or the discharge date.

In practice, the CRAs tend to report BK7s from the discharge date and BK13s from the filing date.

One of the biggest score-draggers I have is a judgement that was filed AFTER I filed my Ch7, by a creditor that was included in the BK, therefore, was filed in violation of bankruptcy law, which says once a consumer files you can't continue pursuing collection efforts.  EQ and TU marked it "satisfied", EX did nothing, but even that isn't sufficient.  I want it GONE.  It (the judgement) never should have been filed anyway and doing so was ILLEGAL.  The OC says they are working to vacate the judgement and have admitted their error, but we'll see.
