Disputing False Judgement

I have disputed a  false judgement that was appearing on all 3 CRAs and it was deleted from TU and Equifax. Unfortunately, I have disputed the judgement with Experian twice and they refuse to delete the judgement from my credit file. I have called the creditor that has placed this judgement on my credit file and they claim it is a CC that I had back in '98. I know this is not my account because during that time, I was not even of age to receive a credit card account. Does anyone have any advice on how to clear this judgement with Experian?

Since Ex won't remove it report the situation to www.ftc.giv Has he creditor acknowledged that this is not your debt? If so get something in writing. Explain you were a minor at the time. Request that they remove it. If they don't advise that you will report to the ftc.  Last timed I read a T&C, you would have had to be 18 min.

Re: Disputing False Judgement

This would not be the first time EX refused to follow the law and investigate. BTY. After you get it removed, further investigate how it got there in the first place. Could be causing problems else where too. I would also check with the state to see who's name is on it. That might be enough proof if you can obtain a state copy of the Judgement to send in to EX. Sorry that you have to do all this work. EX can be a bit lazy. Keep pushing.

Wait. I might have this confused with a Tax Lien. But still Judgements still have to be legal paperwork. See if you can get a copy through the local court. I believe it should be something listed on the judgement. Sorry. I really don't have much experience with this. Just trying to offer help.

Re: Disputing False Judgement

MOV = method of validation (not yet on abbreviation list, sigh)

The CRA has to show you that they have checked the validity of the account, and tell you the method by which they did it.

Type MOV into the search box on these pages--it should pull up a bunch of thread links.

Re: Disputing False Judgement

Thanks for clarifying MOV. I was just wondering if anyone had an example of a MOV letter to the CRAs. If so, can you please provide me with this. I've tried searching through the thread and I'm having no luck.

Re: Disputing False Judgement

Qweaver 2005...Excellent step by step instructions can be found if you would type the letters MOV in the search box in the upper right hand corner of this page. The tenth item down on that page will guide you through your situation. Let us know if you require further assistance. TU=800 EQ=803 EX=813

Re: Disputing False Judgement

Since you were a minor and you know that account was not yours, you should consider filing a police report for identity theft as well, just to protect you in the future and to strengthen your case with the CRA's.

Re: Disputing False Judgement

You might want to talk to a lawyer. Their might be a suit possibility against the CA for damages to your credit and financial losses. That's what I'd do. Experian does check other sources such as state and local records. You might also want to check these records before exhausting any more energy on EX. A record might exist with your name and social. Maybe be identity theft a while ago.
