Do I have a Case

I recieved a letter from a collection company in re: to a bill dating back to 3-8-03 from Zerizon in the amount of $91.67...long story short I sent a dispute letter and did not hear back from them for 60 days.I spoke to a woman on the phone who then tells me that debt is no longer due...I ask why and she says it will take to much money to prove I owe it, not making it worth their efforts.In the mean time I had checked into credit check and low and behold there is was posted..when I asked her she said it was taken off thsi morning and could take 30 days to be taken off the report.I asked her why would you report something you admit you can not prove and she told me it was a MISTAKE!I am seriously thinking about taking them to small claims court for defamation??????

Hi Islaguy,

Just my thoughts. I understand how you feel and why you want to take them to task on this. But if the ultimate goal is to make this go away and not have it damage your credit, it sounds to me like that has been accomplished. If they correct the "mistake" and the TL is removed then no harm has been done.

IMHO you should focus your resources on building your credit instead of beating a dead horse. IMHO.

I agree with O6. Their actions do not appear to have been malicious with forethought to harm you, they have admitted their action was incorrect, and you have suffered no identifialble monetary harm. Mental distress, in and of itself, is a poor grounds for legal action. There is no public disclosure, as your CR is restricted.

Give it up.
