Do I have the right plan?

I have read a lot on these boards over the past month or so. I have to say there is a lot of useful and good to know information on here. Only if I'd found them sooner. That being said......I am trying to get my husband's credit cleaned up. I have a copy of his credit report from Equifax that a creditor gave me. Here is what he has.

Collection items-

NCO FIN/99 - Assuming this is NCO Financial?

         Amount- $78   Balance- $48   Listed 01/01   Reported 06/07

Cavalry

        Amount - $66  Balance- $66   Listed 03/03   Reported 06/07

Medical (no collection agency given)

       Amount- $16  Balance - $16  Listed 02/03  Reported 07/06

Medical(no collection agency given)

       Amount- $26  Balance - $26  Listed 10/03   Reported 07/06

ACS Collet

     Amount - $29  Balance - $29  Listed 11/01 Reported 04/06

CBCS

    Amount - $216  Balance- $216  Listed 09/04 Reported 10/05

MID SO CR

    Amount- $150  Balance- $75  Listed 11/02 Reported 01/04

MID SO CR

   Amount- $165  Balance- $165 Listed 11/02  Reported 04/03

Then under accounts it has the following:

MIDLAND

Reported 06/07, No date for when opened, High Credit $275, Past Due $275, Balance $275
    DLA 03/03

Underneath this item it states " Consumer disputes this account information".  We did dispute this
as to we did not know what it was,  but it has been over a  year since we disputed it and we have
heard nothing. Still have no clue what it is, who the OC is or anything else.

LVNVFUNDG

Reported 06/06, No date for when opened, High Credit $216, Past Due $216, Balance $216
DLA 04/02    It then states Collection Account below this.  This is a collection account from MCI
which is already listed up above under "Collection Items" under CBCS.

Then there are 16 other accounts that are all marked " Closed or Paid Account/Zero Balance". They were all paid accounts. A few years ago we were told to go to the small loan places in town and get loans and pay them off and this would build our credit. I have read on here that this in fact might be hurting our credit. It isn't from 16 different creditors, they are from just 2 creditors. The loans started out low, what they called "credit starter loans". As we paid the loans we could go up a "level" and get a little higher loan. We started on level one and we are now on their highest level with one of the companies, and about half way up with the other. So we have 3 open, marked "paying as agreed, never late, except one time last year.  When these are paid off in just a few months, they are staying closed. These are all installment loans.

Then he has the Ford Motor Credit Account. It is reported as:

     High Balance $9900.00, Balance $0, Reported 11/05, Opened 09/01 DLA 11/05
     Closed or Paid Account/Zero Balance
     AUTO

Was paid off a year ahead of schedule, but shows a few late payments.

The majority of these items,  well all except for the positive installment loan accounts, occurred before we were married. He didn't realize that his credit was actually useful and something he needed to take care of. Some of them are just silly and I could kick him for not paying them. What a dufus he was. What I don't understand though is that some of these didn't even report until AFTER we were married which is actually up to 3 yrs after they actually occurred.  Most of the items are medical, the MCI is from his sister having a phone in his name. A few of the medical is because his insurance changed, doctors offices were given copies of new insurance information but continued to file with old insurance. We called MCI, they said without the account number they could not give us any information. I tried to explain that we did not have an account number, because we never had the telephone, his sister did. We have asked for proof of the bill, was told we needed account number. A few months back we got a letter from the CA concerning this. I called and told them that we disputed the bill due to it not being ours and have never heard from them again.

I know it will take time, but I have faith for getting all this cleaned up.

So here is what I have planned:

Send PFD letters to them all. None of them are that major so I will offer to pay in full.

Should I send letters and try to get some of the closed accounts removed?  Creditor A has 11 accounts listed, 10 paid off/closed, 1 open. Creditor B has 5 listed, 4 paid off/closed, 1 open.

I thought of sending a GW letter to Ford Motor Credit and ask them to remove the late payments? Chances of this actually happening?

I know his credit scores are 574, 533, 533 (according to a creditor, but I never asked which score from which company)

One of his other credit reports also list him owing US Bank  $642. He says that he deposited his paycheck in his account, the bank decided to hold the funds because the check was from out of town (which they all state they have the right to do) but he had worked for the same company for over a year and they had never done it before. He didn't realize they held the funds, he wrote checks and they bounced. So he refused to pay the overdraft charges, which is the $642. This was at least a year before we meet, which means it's been at least 6, almost 7 years.

Which would be better, send them a PFD letter(which I'd offer a settlement offer) or wait another 6months-year and let it fall off?

Any input would be greatly appreciated and thank you for taking time to read this.

CRTP doesn't change       BUT SOL might

Call CRAs and ask for drop off date on everything.

The dates listed and reported mean nothing!!!!  you need DOFD or DOFA

Most that I see are CAs   and nasty ones. they will not think twice about suing you so KNOW your SOL.

Dispute everything on your CR   and for the one shown as in dispute   tell them that it was disputed over a year ago & as they could not verify in all that time that they need to DELETE it.(doesn't mean that they will) ya never know
.
DV every CA that you have....DO NOT SIGN DV LETTER!!!!  just type everything & in letter say>>>>as validation I want complete documentation including signiture and complete account history...this is in addition to name of creditor and amount owed.  also add  *all communication is to be by mail!*

Re: Do I have the right plan?

Thanks for the response.  I went to the link you provided and for written contracts and promissory notes it is 10 yrs. For oral contracts and open accounts it is 5 years.

I have a few more questions.

If I PFD the CA and they accept, even though they delete the account from the CR, can the OC go back and report it as closed, settlement offer accepted or something of that sort?

I am going to contact the CRA and see about having the disputed one removed before contacting the CA again.

I plan to DV a few(Midland(if not removed b/c of dispute) and CBSC), but as for the small ones, I think I am going to just write a PFD and see if they accept and then DV if they don't. Seeing as we are not acknowledging the debt is valid in the PFD, we can DV after sending a PFD can't we?

Thanks,

Kristy

Re: Do I have the right plan?

Usually medical creditors do not always report...they turn it over to a CA.

First look at your SOL. Then if past DV the CA.....NEVER SIGN YOUR NAME to a CA and send CMRRR

If your SOL is past that is when I would PFD....because they can not file suit, so they have to take what they can get.

Speaking for myself....I pulled my CR for the first time just as SOL past,so I didn't have to wait or pay anything.

Always remember SOL...If you want or can PIF   PFD

Even when filing a dispute remember SOL   there is a thread here tonight  read it

Usual  you would  dispute with all 3 CRA  at the same time
Then if you want you can DV a CA at the same time...wording is important only in 1 way...READ DV

Never talk to a CA...Never sign your name on a DV letter & ALWAYS CMRRR
The only time to sign name is to the CRA...no one else

Re: Do I have the right plan?

I apologize for asking so many questions but I have a few more.

Can I request DV, even if I did not respond to the letter they sent saying, "if you do not notify us within 30 days, we'll assume this debt is valid"?

and......

I looked up the SOL for my state......was wondering where a few things would fall.

Medical bills..........written contracts?

Any debt to a OC where nothing has ever been signed would be considered oral contract, right?

With the small amounts I am not to worried about them suing, I mean would they really sue over $16, $29, etc if I am offering to PFD?

The larger amounts are the ones I want to be really careful of so that they don't sue and possibly leave another mark on my credit, right?

Thank you again for all your help.

Always ask as many questions as you need. Someone can always have a better way to handle things.

I can't see them suing for small amounts & yes I would PFD.

CC are usually open accounts....Hospital in MOST states have no SOL.  Dr bills have SOL

A CA that wants payment is covered SOL.

Re: Do I have the right plan?

If I PFD the CA and they accept, even though they delete the account from the CR, can the OC go back and report it as closed, settlement offer accepted or something of that sort?

I know I have seen this next one asked and answered on the board but can't remember the answer or find where I have seen it.

Can the OC and CA both report the same account on your CR?  If the answer is yes, then would I be better to PFD the OC and then send for DV to the CA?  If the answer is no, then who would I dispute on, the OC or CA?

Thanks.
