Re: Does a judgment need to be ordered before wages can be garnished on federal debt?

I might be jumping the gun here, but if the garnishment is "disciplinary" in nature (such as defaulted AAFES), the WG might not be as bad as what COULD have happened: a knock-down in pay scale or LOR.

Ex got BOTH when he defaulted on his AAFES account. They were NOT happy with him to say the least.

The IRS sends a notice of intent to levy and then slaps a lien on anything you own.  They can take all your pay and leave you nothing if they so choose.

Thanks.

Just to clarify, the military can garnish wages without judgment, but can the CA collecting for the military?

The debt is several years old, person is no longer in the military.

I'm 99% sure that a CA, collecting on a debt assigned to them by the military (or any Fed or state gov agency) can NOT garnish wages, nor even seek a judgment.

That, AFAIK, has to be initiated by the agency itself.
