I took T's letter and changed the first paragraph b/c I'm not really a confrontational person and thought maybe I could just lighten the mood of the first paragraph??????

Also, this part- It will be implied that this letter shall constitute a legally binding contract, enforceable under the laws of my state.

The charge off/judgement occured while I was living in New York City. Should it say, enforcable under the laws of CT and NY???????

Dear Sir or Madam:

I have been a Chase customer from December 2001 to April 2005 and during most of that time I was a good customer, until July 2004 when my “downward spiral” began. I am aware that I had not been fiscally responsible but I have learned my lesson and for the last couple of years have been desperately trying to undo my mistakes. I am writing in hopes that we can work something out.

I am willing to pay this account IN FULL if you agree to immediate deletion of this account from any and all credit reporting agencies (Equifax, Experian and TransUnion). Chase Manhattan Bank USA/JPMorganChase agrees to delete ALL information regarding this account from the credit reporting agencies WITHIN TEN CALENDAR (10) DAYS following receipt of payment as specified above and will not discuss the terms of this settlement with anyone. If contacted by any third party, including credit-reporting agencies, Chase Manhattan Bank USA/JPMorganChase will not acknowledge that any settlement offer was made, accepted or executed and will, in fact, deny knowledge of any such account.

If you agree to the above terms, please prepare a letter on your company letterhead explicitly agreeing to the same terms as the above settlement offer and have it signed by an authorized representative of Chase Manhattan Bank USA/JPMorganChase. It will be implied that this letter shall constitute a legally binding contract, enforceable under the laws of my state.

Your response must be postmarked no later than 15 days from your receipt of this settlement offer or this offer will be withdrawn and I will request full validation of this alleged debt, as provided for by the Fair Debt Collection Practices Act.

Sounds good to me. Is this a judgment or ust a Co sent to a CA. If they got a judgment against you then you should direct your letter to the people who sued and got judgment. Chase will not talk to you if they sent it to attorneys.

OH NO! It was sent to collection then to judgement...and now is showing up as a Public Record. But looking at my credit reports, Chase is the contact. Looks like they have their own legal team.

One more thing...I don't necessarily want the account to disappear. I just want it to show that it was paid in full and closed (b/c obviously they are not going to re-open it for me)...and no collection or judgement to show.

just realized...am I owning up to the account in the first paragraph, making the rest of the letter not valid...meaning that, they can come back to me and say- You say this is your debt. Even if you do pay the full amount we are still going to keep the Public Record on file and the collection on file!!!

OMG! I definitely don't want that.
