Don't they have to tell you first!

Hi, I just called Fidelity Amex, to ask for a CLI and was told they had to ask me a few questions / Income / Home / Job and so on. I agreed and answered the questions then was told they may need some more Information and someone will call me within 3 days I said that's fine and hung up the phone.Once I hung up I received a text from TU Credit Service saying an inquiry had been placed on my report!.The CSR, didn't say anything about pulling my report! maybe it's just me. But don't they have to tell you first?  Smiley Mad

I don't think they do. Any application or request for credit gives them the consent to pull.

No, they dont have to tell you or get your permission.

No, it is not new.

 

FCRA 604 lists reasons for credit inquiries which, if present, provide permissible purpose for a party to pull your credit report without any permission or advisory to the consumer.   If they meet a permissible purpose, they have authority to pull.  They must only proivde a statement to the CRA of their permissible purpose.

The FCRA is structured that way to facilitate the process of approval of credit and business transactions.

Otherwise, those processes would come to a crawl.

 

A consumer request for new of additional credit is a stated permissible purpose which provides basis fo a hard credit inquiry

I'd suggest always assuming a hard pull unless you just enjoy being disappointed.

BoA is 99% likely to hard pull for CLI. And agreed, if you always expect a hard pill consider yourself lucky if you get a CLI with a soft pull.

I didn't mind the HP. But this is the first time this has happen without someone saying up front it was going to be a HP.
