Hi everyone, brand new to the forum. I recently sent ERC a detailed goodwill letter that I typed up on Word and then emailed to a customer service email, I emailed it on Jan 8th, and when I woke up the 10th, I had an email back that said this:
Thank you for your inquiry. A deletion has been submitted to all three credit bureaus in association with the account. Please allow up to 45 days for the update to appear on your personal credit report. If you have further questions or concerns you may contact a general representative at (800) 617-0049 during the following office hours: 8 am-11pm Monday-Thursday, 8am-7pm Friday and 8am-5pm Saturday.
My question is, it's the '31st today, has anybody experience just how long it may take for the collection to drop off a report? I know it's only been 21 days but I am just so anxious lol. I was really shocked when they emailed me that back. I'm all ready to apply for a mortgage on an investment property but I'd like to see what my score does with the collection gone. The collection is a year old.
That is great. Unfortunately, the collection is still on my reports and it's been 38 days since they said they submitted the deletions. I'm anxious and worried that they won't actually delete them.
Go to www.consumerfinance.gov and file a complaint against ERC. Tell them they agreed to delete it.
I would not recommend filing any type of complaint with the CFPB based on a voluntary, good-will promise.
They are under no obligation to delete, and thus there is no violation of the FCRA of FDCPA based on any period for deletion.
A complaint may kill any feeling of good-will that previously existed.
Since you are not providing anything of value as part of their voluntary statement of intent to delete, you do not have a legal contract to enforce.
They are likely including any update in their next regular reporting cycle, which could be up to a month to send out the door.
It is unlikely that they will do a special reporting for only your update.
Add CRA processing time, and it can extend to more than a month.
I would give it up to the full 45 days before even calling them......
My experience is they fear fines from CFPB. They do not care about individuals, and they rarely delete anything off your file without oversight from a higher power. But they do fear the power of the CFPB once they know you have officially a complaint. But here's some advice... if in the complaint you say that the collection is legitimate but you just want it off your record, then obviously you lose. You have to claim that it was not legitimate and make the collections agency prove that it actually is valid. And something that works in your favor, is now you have a letter from ERC stating that they will actually delete it. So when you make your complete with CFPB just tailor your complaint to include the fact that they agreed to delete it. Just go on CFPB website and type in ERC in the search field, you will see how many others have dealt with them particularly.

I doubt OP would've gotten a letter stating they were going to delete it if ERC actually owned the debt and it was valid. Even so, it is up to the collection agency to prove the validity of the debt. That's why when collection agencies can't prove valid debt, the credit bureaus delete the information off of your file. Just go to CFPB website and search ERC. Study how others have found success.
OK guys creditkarma updated today and it was removed on Transunion! The debt was legit and I took full responsibily for it in the letter so saying it was not mine would be wrong. The fact that they were even nice enough to say they would delete it, I would not file a complaint this early however now that it has been removed from TU, I am sure it will be removed from the other 2 very soon.
