Make sure to describe to your lawyer exactly HOW you received the Summons.  There are strict laws on this -- they have to "serve" you with the Summons properly.  Each state, and sometimes individual counties, have different laws.  Did someone come to your door and ask "Are you secchange?" and give you the Summons? Or did they just mail it?  Was it attached to your door?  If they didn't serve you properly you may have a defense, although they may be able to start the whole process over.
 
Also tell your lawyer if they told you they already had a judgment against you.  If so, they may have violated the law.  Or did they only say they "will" get a judgment? They can't get a judgment until they go to court and win.

Very important to make sure you were legally served.  OP, Pro-se clerk can give you the Affidavit of Service.  You don't want to miss any opportunity that might wind up helping you, like improper service.

Smiley Very Happy  Good stuff.  And even better that you will be at least trying to get whatever free legal services you can.  There are usually free Legal Clinics, lots of attys will give you a consult, and also the Legal Aid hotline here in NY should give you a few numbers of attys that do so. Smiley Happy

Unles you are headed to circuit court you will not need to hire an attorney - you can represent yourself in small claims with the advice (via a free consult) from an attorney.
 
Did you receive anything with the summons - any documentary paperwork?
 
Typical 'answer' will include:
 
Defendent denies all allegations made by plaintiff and requests the earliest possible date for trial.
 
(1) Defendant is requesting discovery of all media related to this action (list from Lonnsters DV on the motion)
 
(2) Defendent asserts that Statute of Limitations has expired.(prep motion)
 
(3) Defendent is filing a counterclaim for violations of FCRA, FACTA, FDCPA and (your state's Consumer law)
 
(4) Plaintiff failed to properly serve defendent under the laws of _____(state). (Make them prove good service)
 
(5) Defendent is filing a counterclaim for wrongful suit, defamation of character and harrassment. (this has to do with them filing after SOL has run and since they are attorneys they know about SOL)
 
Now prep 2 motions and 2 counter claims and on #3 & 5 ask for the max allowed by your small claims court (can always be lowered but not raised)  The counterclaim must be detailed as to which sections of the code you feel they have violated (but not how - that is for court)
  Present to Judge in the following order: 4,2,1,3,5

My attorney won my case on this info!!!!!  I was also told by my attorney that all this info should be included in a DV.

First of all THANKS SO MUCH for all the posts.  So just a couple questions.
 
they called me this morning at work....i still am not sure if this is the OC or CA.  how do i find that out?  should i call back the number they left with me and ask?
 
pls forgive my naivete.  my brain is completely scattered.
 
A friend suggested I start with two things right now is this correct??:
 
1.  write DV letter and send out today
2.  file a motion to vacate judgment today (pro se)
 
is that the correct plan of action right now....i want to make sure i do the right thing in correct order as not to shoot myself in the foot - sort of speak.
