FAST response to PFD

I sent out my very FIRST (and only) PFD last Saturday and as I type this, there is a certified letter to me from the CA sitting at the post office! I am so nervous! I can't believe they responded SO quickly-- is that a good thing or a bad thing?! I hate that I have to wait until morning to go get the letter! Ahhh! What if I get sued!?

Sincerely,

Re: FAST response to PFD

If you think about it, a reply should be fast. How long does it take to say yes or no?

Guess you'll be wondering until you open it. No pressure or anything...

OPEN IT Smiley Happy

The worse that can happen is they reject your letter.

Re: FAST response to PFD

I DO want to open it, but it's at the post office right now Smiley Sad I was not here today when they came to have me sign (CA sent it CMRRR) so I am going to go first thing in the morning. I feel like a kid on Christmas Eve, am I going to get a present or COAL?!

I will update after I read the letter. If they agree to the PFD I am going to need this forum's help on the next steps to take--please!

Re: FAST response to PFD

Well the account is from rent that my old roommates didnt pay (long story). I checked the sites around here that give time-frames for SOL and I couldn't tell if it was 3 years or 10 years. But I want this stupid TL OFF my report, I don't really want to be sued but I figured I had a better chance with a PFD at 60% settlement. The original amount is $680, I offered $408. I dont know why they would sue me for an extra $270 but I wouldnt put it past them. If they don't agree to the PFD I am going to request DV and dispute as "Not mine".

I live in SC btw...

Re: FAST response to PFD

GOOD NEWS!!! I think...

I picked up my certified letter today from the collection agency (I sent them a PFD very similiar to the first example letter on the Credit Scoring 101 thread) and this was their response:

Dear Ms. L*******,

Our office is in receipt of your letter sent to us and dated September 7, 2007. Without more information, we are unable to locate a Megan L******* in our system. The account number that you have provided does not have a match in our system.

Please provide more information, or call Mary Long at ***-***-****. I will need your social security number, date of birth, other people who may have been on the lease (if any), and other names you may have gone by.

Should you have any questions, please feel free to give me a call at the number listed above.

Sincerely,
Mary Long
CA

Of course I am NOT going to call them and give them any more information on me. If they can't find me by my name, tough poop! Mods, please advise on what to do now! I am thinking, send a DV letter and dispute with EQ (or all three bureaus? I think EQ is the only one the collection appears on...)???

Re: FAST response to PFD

Hi Megan,

I'm not a mod, but I have a suggestion.

If the CA is reporting to a credit bureau, the burden of proof is on the CA to prove that what they are reporting is accurate.   They can't find the information in their current system, so rather than pay money and spend time on trying to find out the information, they're trying to trick you into giving the information to them for free and in no time flat.   (Note: The only thing that you should give them is an account number that they're referencing on the report).

Once you give them your personal information, what they'll do is look at their original lists that they received from their "clients" {the OCs from whom they purchased the bad debt} to try to find your record.  The original lists will contain your personal information.

Don't do the verification legwork for the CA.  Here's what I would do: dispute it with the CRA that's reporting the entry.  When you dispute the entry, send a copy of the letter (keep the original) from the CA as "proof" that this is "not yours".

Hey Jenn--Thanks for the response!

I figured they were trying to trick me into giving them info (which I will not do) as I already gave them the account number that was on my credit report.

I guess I will just send a dispute to EQ and hope that the TL gets deleted.

Thanks for your response and any others would be appreciated!

P.S Should I send my dispute letter to Equifax CMRRR?
