One way or the other that inquiry will have to be removed from my EX file because they did not have any authorization to inquire on my file. If I could get more than 1K from suing them, I would pursue a lawsuit but it's not worth it for 1K. Legal fees would be more than that. But good luck to you folks, these guys are aholes!
Two weeks later I sent them a registered receipt letter indicating that the debt was in dispute. Rather than send me Verification of the Debt, they immediately reported Collection Notices to all 3 bureaus indicating "Debt disputed by Consumer".
Per the terms of the Fair Debt Collection Practices act, weren't they supposed to first send Verification of the Debt before reporting it to the bureaus, especially since I sent them a Dispute letter only two weeks after receiving their first letter/notice?
In fact, it wasn't until 3 months later that I finally received a Verification of the Debt letter from them. I've since written them 3 letters indicating that they violated the Fair Debt Collection act and all they keep sending me are Verification of the Debt letters.
Do I have any legal recourse against them?
I have a paid bolections with them ( prior to knowing about the help here!) I tried a GW letter but all they did was send me a letter validation the fact it was showing as paid on my credit report. My question is they did several hard inquires on my credit report. I have seen conflicting opinions on if this is a PP. Does anyone have an opinion? I'm hoping to get some leverage to have it deleted.
