First time victim of fraud, need help please

So, I log into my account tonight to look at my account and check my credit and find I am now a victim.  

 

Details:
I recently had a BK discharged in November

I was approved in July for my very first ever (And only) CC

It is Capital One credit steps program with $300 limit.

The amount of the fraudulent charges was $297.79

I changed the pw on my account

 

So I am looking at these charges and they are all from local fast food places, all places I have gone in the past using this same card, all right around the same amounts that I normally spend.  None of these places require signing anything, it is just swipe.  

So I have a few questions:

1. What is the general process for Capital One fraud reporting?  How do THEY handle it?

2. What do I need to do to ensure this money is refunded to me properly?  Will I need to contact the restaurants? Police? 

3. Will the police or C1 obtain security videos from these restaurants to nail the S.O.B?  

4. If I am fairly certain of who did it, do I tell them that,and see if they verify it through previous said video footage?

5. How long does the process take with C1?

6. Will they question me about the validity of this since it was used at places I have been before?  I have read that if I used my card somewhere before, they will disregard that claim.

 

Please help, I don't know what to do here, I feel really helpless.

Actually, I did some re-calculations, the actual fraudulent amount is $164.85

Contact Cap1 and report it. They will tell you what has to be done. Don't depend on any responses you recieve here. People try but not always right on their opinions. I have an opinion but wouldn't want to give you false information in case I am wrong. Good Luck!

Call CO and report ASAP.  They'll guide you through what they need.

I agree you need to talk to Cap One ASAP . Sounds like someone has your card number and has a  replica card made and is using it.

Definitely report it immediately..  Make sure you can tell them which charges are not yours.  I have a really odd question.  are all of the charges exactly double or if restaurants are 1 the charge without tip and 1 after tip.  Just wondering if there is a glitch with cap 1.  

 

But all fo that aside.  Call Cap 1 immediately

Just....report it. Why do you have all these questions before you've even called Capital One? They can walk you through all the steps. But be warned, and I say this cuz you have such a small limit-they may *temporarily* refund the charges while they investigate. But if they find the charges to be legitimate, as in, these ARE your charges or they don't agree with your allegations of fraud, they WILL re-post the charges and looking at what your stated legit balamce is, if you've used the card more without making a significant payment, you will be over limit...

 

So I wouldn't use the card for the amount of the disputed charges, even though it may show available while the dispute is in place. There will be no warning they're recharging it, and putting you over limit will ruin your credit steps chances with them. 

 

Trust me. I worked there for years, in several departments. And no, I'm not going to get into their fraud detection techniques. I will say that most people aren't worried about video evidence, though, when they feel their card has been compromised. You'd be amazed at what I saw working there (and in disputes).

yes immediately contact the fraud department! id opine that you should fill out the FTC id theft form and take it to your nearest police station. have the officer make the report but show physical proof. in the event crapone tries to report negative you can invoke your rights under FACTA. and if they go further you can bring charges see Osada V. Experian. its always smarter to be vigilant as opposed to complacent. the FTC complaint will go into sentinel where the FBI USDOJ and local law enforcement work together. good luck
