Gym Collections

I had an account which I closed out at a local gym a few years ago. They said I never closed it out and I can not find the receipt. I know I paid, and paid with cash, but I cant find my receipt. What are my options? I called Sure Recovery Service as I saw it was on my credit file, and when I called my gym, they told me to call there. The woman was actually helpful and she said go there in person to dispute the matter. She said I may get some help. What should I say when I go? I have joined a gym since then. HELP!

Re: Gym Collections

First step:  Dispute it with the CB first.  Hopefully the collection agency will not respond, and it will be removed.

Option #2:  Contact the manager of the gym, tell them that you haven't used their facilities since you closed your account out, and tell him the date.  He can clearly look and see when the last time it was that you used their facilities (provided they keep a history on their customers - all good gyms do).  Ask him to look that up, too!  Most likely he will cancel your account and backdate it for you.  If he doesn't, then maturely and kindly inform him that you are contacting your attorney, give him a chance to respond, and then maturely and kindly end the call.  Then follow up and sue him in civil court (you may be better off in a small claims court).

Personally, I'd DV the CA now. You talked to them on the phone, so they know you are aware of the account. Send them a DV and see what you get.

You might call the manager of the gym first, or call corporate if they have a corporate office and nicely explain the situation and why you feel the reported account is an error and see where you can get.

My spouse just had a CA report on CR, still hasnt' gotten anything in mail, but it was for socket internet. Signed up for a free trial Feb 07, it lasted 6 months. Cancelled in August and they had a collection saying $151.00 was owed. After looking up on their website and seen where the account was never cancelled as requested and there wasn't no usage activity since August 11th, emailed socket and explained it and they emailed back saying that they checked and saw no activity since August as  said and they would instruct the CA to delete the account.

I don't know about threatening to sue the gym, as it is your word against theirs. You have NO proof that you paid. If YOU sue THEM, I think the burden of proof would be on you. And you have none. And I certainly wouldn't threaten if it is an empty threat. But I could be wrong.

Re: Gym Collections

1) I disputed it, and the CA responded very quickly =( 2)When I had called there, they said they wouldn't talk about my account, that I had to call the CA directly. The woman at the CA said go back in person if you think you have a valid dispute with them. Should I go in person and tell them I lost the receipt and my financial situation of why I left the gym in the first place?

Re: Gym Collections

I have a DV letter i am hand delivering, and also i have a breakdown of what I owe... can they charge random amounts when i only authorized $30.00?

Also... I mailed out a PFD for a Med Bill asking for a 50% settlement using a letter on here, but tailored it for my individual needs.
I also wrote a GW letter to Commerce Bank asking the delete my (5) 30 day lates...

I am new on here and greatly appreciate all of the help you (all) are providing me with, whether it be directly answering a question or for the people that post their letters for me to reword and use.

There is a lot of info on these boards and as I learn I will hopefully be doing more contributing than the asking of questions.

In the mean time... now is the waiting game!
