HELP Please! Judgement Questions

Hello again! I have a question about a judgment that is on my CR from April 2007  and am in desparate need of some advice. The original creditor was HSBC for a Visa credit card. The debt was charged off/sold to a CA early in 2003. I was made aware of the debt again in April of 2007 and the CA then filed a judgment against me (while I was on my honeymoon and couldn't be reached to agree to pay before the judgement was filed!!!). The SOL was 11/2007 so they were within their rights to do this.

I do not dispute the debt itself, and have paid the judgement to the CA/courts in full. However, after looking closely at my CR's recently, I believe that the judgment that was paid was almost $900 more than the actual balance of the card when it was charged off! This amount does NOT include the court costs--with those costs the total paid is actually about $1200.

My first question is how can I find out exactly what the amount was for? Can I DV the original creditor even though this went to court as a judgment? If I do confirm that the actual amount owed is less than what I paid, what steps do I take next? Do I send a letter to the CA demanding they remove this? At this point I don't care about the money as much as I do trying to get this removed from my CR.

THANK YOU!

Re: HELP Please! Judgement Questions

Im sorry that I can not answer with knowledge. I think that you would need to consult an attorney. I do know usually once a judgment is issued that you can do nothing about it (I could be wrong).

Wait and see if someone in here can offer more advice.

Re: HELP Please! Judgement Questions

You need to head to the courhouse and look at the file.  There should be a breadown of the judgement amount - including costs and attorney fees.  Check for sevice also --- if not properly served then possible to have it vacated.

Re: HELP Please! Judgement Questions

Were you ever served w/papers or were you on HM on court date?  If you were not properly served, you can get judgment vacated. IMO
