HELP - trouble with Experian nightmare

I found out today that Experian merged my credit report with another person who has a similar name and social security number. This person has the WORST credit. Multiple civil judgments and collection accounts. I called Experian and they removed 68 of the wrong accounts from my report. However, there are another 12 they claim they "don't have sufficient information" to determine the accounts are not mine and so they won't remove them without an investigation which will take 30-45 days. I have okay credit now, have worked hard to rebuild after a BK 5 years ago. I am worried one of my creditors will see my "new" report with the extremely derogatory information and react by reducing my available credit or raising my interest rates. Experian claims they can't do anything about this, even though it was THEIR mistake that merged my credit report with someone else's. What recourse do I have if I am negatively impacted because of Experian's mistake??

You might have decent chances in small claims court.

 

I would also contact the creditors listed in error on your credit report to see if they can help speed up the process for the CRA.

Do you have a copy of your EX report prior to the merge? It may help you prove what your report looked like prior to the "mistake".

Thanks for the advice. Ironically, I do have a report dated 1 week prior to this mess. I belong to a credit monitoring service that lets me pull all 3 credit reports 1/month. It was an alert through this service that let me know about this mess. Needless to say, I am a HUGE believer in credit monitoring after this!!
