Happy Days/Hauling/Scarlet Anyone that can help!!

Am looking for advice on how to combat this reasoning.  I have been talking to the rep at Drive Financial.  Very nice and prompt.  First, I discover today that they did a hard pull on my Equifax.  In addition, per their request, I faxed them copies of my credit report showing the account listed twice.  Here is the rep's explanation and she is calling me back on Monday because I am challenging her on the points below and asking for an explanation and she is at a loss to explain it and so runs back to the credit reporting department all the time for explanations.  In addition, I ask why she can't just delete the one account and she said if they do, both will disappear.  What?????   so I would like some advice on how to get this taken care of. 
 
According to their credit reporting department, the one account was "closed" when I filed BK.  Then they "reopened" another account, with a different account number to show the bankruptcy filing.  This account is suppose to be reporting as active and she told me that once discharged will be changed to "paid" status.   This just baffles my mind.  I had only 1 car loan with them and it takes 2 accounts to report it????????  (this is OC not CA that is duplicating)
 
Now first of all, both accounts are showing as included in BK, IIB.  Secondly how in the world do they need 2 accounts to show that 1 car loan was IIB?   I am at a loss here.
 
So is there any ruling anywhere that states this is not the way to report this?  None of my other accounts have needed 2 accounts to show it as IIB.  I am at a loss.

Yikes --passing this off to HappyDays and the others, including Timothy and fused.

Doesn't make sense to me, but this is way beyond anything that I know about.

The best I can do is fall back to the soft inq option. Maybe they could report it as a soft instead, which wouldn't hurt you. sorry! Smiley Tongue

Hauling is just so kind!
    granny they are not reporting right!  I would send them a letter stating that you had 1 account with them & it was included in your BK.   This is reporting 2 times on your CR. Please delete the dupe. account.
 
Send it to the address on your CR.  Usually the person that you talk to is not in the dept. that does the reporting and doesn't really know whats what.
 
I would try it that way & see what happens. I would only disput as a last resort
 
Please wait for Timothy or another mod to have inpute with this.

but that is the point.  I have disputed with equifax 4 times now on this very account.  I have talked to Drive in the past.  Nothing is making the duplicated account go away.  And now Drive is making up this excuse about one will say "paid" and one will say IIB to cover their tracks.  I have scoured the FCRA and really can't find anything that relates to this type of reporting.  So I filed a complaint with the BBB and that is even why this person at Drive called me in the first place.  But she is clueless to what the credit reporting department is doing. 
 
Is my next step to sue these yahoo's?????

I would say YES   send then a *ITS* letter  but follow through on it. Do not just threaten to sue.
 
Have you filed a complaint with the FTC??  I sure would!

I will do it now.  I just finished filing a complaint with the attorney general's office of Dallas.  But the FTC is next.  Thanks

I'd also advise this dunce that if she is clueless as to how the credit department works at her company, she needs to quit trying to handle the situation & get you a rep in the credit department that actually knows how their own processes work.

it is ok.  I appreciate  all the help I can get. Smiley Happy  I just filed complaints with the attorney general's office in Dallas and also with the FTC and will see how that goes.  Yvonne I think is in public relations not credit reporting and she is just trying to not have a negative report on the better business bureau site cause that is where I started the whole complaint process.  But at least it got me a phone call from Drive.  LOL  I will keep you posted on my results.  If I get no satisfaction, then I will sue.

Well at least they're interested in their reputation, granny. That is so much more than many other companies can say for themselves...
 
But I (being frank and sometimes blunt like a rusty nail) would probably say to her during the next convo, "I know you're trying to keep your company's nose clean and the best thing you can do is put me in touch with someone in the credit department who can actually solve my problem, instead of just trying to make me feel better about it..."
