::::::::update:::::::::Re: Happy Days/Hauling/Scarlet Anyone that can help!!

well today I received an email from the BBB telling me that Drive had indicated that we were working on a resolution and they wanted my feedback.

I told them we were working on it but I did not agree with their resolution which was to do nothing to fix the duplicate reporting and that I had also contacted the attorney general of Dallas to file a complaint as well as the FTC.

No call back at all today from sweet Yvonne.  Don't know if that is because the BBB told them I was NOT happy that they were not going to fix this issue or that they now know I filed complaints with the attorney general's office and the FTC.

I heard nothing back from either of those two but then they are big and my complaint is a small fish in the pond.

In addition there is nothing that I can find in the FCRA that addresses an OC creating 2 accounts with different dates and numbers to report. I sure would like to have some legalese to back me up in my fight.

I pulled tru credit today also and both accounts are still reporting.  Smiley Sad

Be very careful when dealing with Drive Financial. They are very bad people. I had nothing but heartache with them. They are still doing hard inquiries on my CR and after selling the deficiency. I too filed with the BBB, FTC etc. Drive sent them a different letter than the one they sent me. They sold the vehicle without first notifying me. Then a few months after the vehicle was sold, sent me a letter saying if I PIF they will release the title to me.

did you get any satisfaction from the FTC?  My account was included in my BK.  So it should say IIB/zero balance.  But they "created" a second account with different account numbers and then tried to tell me they had to do that to show the account IIB.  It is BS.  What they did was illegal I believe to create a second account for 1 car.  I now have 2 derog accounts stating IIB for 1 car with them which my EX let go back.

I did get a letter from the FTC. You do know that they can not do anything other than take complaints about companies. When they receive so many, I guess they check into it.
That is basically what the letter said.

My AG told me that they can not do anything about what I feel is incorrect. In essence, they took the letter Drive sent them and closed the case.

I have let it go for now. If and when Drive or a CA tries to sue me, I have kept everything that was ever sent to me.

I will probably be in the same boat and they know it which is why Yvonne probably didn't call me back today.  But now until 2012 I will have 2 derog accounts stating IIB when I only had 1 car and it is not right that companies can get away with this.  Maybe I will write my congressman.  They are looking at credit cards, why not this too.  Smiley Happy   I put a statement on my equifax but I am the only one that sees it.  LOLOL

update number 2

I just received an email from the FTC on my complaint to Drive Financial.  This is what is said.  Is this just standard response or should I feel encouraged?  The attachment sent was about the FTC and the FCRA and that is provides consumers with the right to fix their credit etc.
