Help, just received a letter from a CA!

Hello,

I am new to the forums.  I have been on myfico for a month.  DH and I just bought a house and I used myfico to pull our CR.   DH just received a letter from a CA about a debt that might be his from an old bank account. They say it is for $844.74 and if we call now they are authorized to accept less than the full amount for a limited time only.  DH says no way it started more than $100 & he was pretty sure he paid it awhile back.  This would have been 6-8 years ago and is not on his credit report.  We have never seen something from this CA...Niagara Credit Solutions, Inc.  I have never disputed something, so your help would be greatly appreciated!!!

Is our first step a DV?

Where can I find info on how to compose this?

Help, credit repair pros!!

http://ficoforums.myfico.com/fico/board/message?board.id=generalcredit&message.id=4328 is the link for the DV thread.  I'd assume that'd be the best bet, hopefully they'd fail to provide you with the info in general, or would send you something showing it's far past date.

A quick look at their website indicates they are not likley a Junk Debt collector-

DV them- use the standard one listed all over here-
Send in CMRRR within 30 days of the notice-

Thanks for the answers.  I added a little more to my post, but it sounds like the way to go is to DV.

You all are great!!

Re: Help, just received a letter from a CA!

I have another quick question about this....

What if DH has received something in the past from them and just doesn't remember it, can you still do a DV letter?

Just curious.  He also thinks this was from 9 years ago.  It says it's from USBank, but he never had an account with them.  When he had an account it was a different bank.

The letter should have the 30 day to DV blurb on it-

They would need to PROVE that a dunning letter was sent in the past-

I would DV asap-

Re: Help, just received a letter from a CA!

Tim,

Actually the letter does not have the 30 day DV blurb on it.  It says:

It's tax refund time-Put your return to good use

Here is an opportunity you won't want to miss.  Our client has authorized us to accept less than the full balance to pay-off your account, allowing you to save a lot of money in the process.  In order to take advantage of this offer, place contact our office at XXX-XXX-XXXX and ask for the settlement department.  One of our friendly customer service representatives will be happy to explain the many benefits of this offer to you- which includes satisfying the debt in full for much less than listed above.

Visa, MasterCard and American Express card holders may pay by filling in the box above and returning the tear off portion to our offices.  Please note all credit card payments will be processed by our merchant and will appear on you statement as a purchase made to Shipman Print Solutions.

This offer is good for a limited time, so call our office now at XXX-XXX-XXXX and ask for the settlement department.

Federal law requires we notify you that this communication is from a professional debt collector.  This is an attempt to collect a debt and any information obtained will be used for that purpose.

Sincerely ,

Settlement Department
Niagara Credit Solutions

At the top of the letter it has the account #'s and the reference creditor as US Bank and the total amount due and a-regarding our client Hoffe & Associates, LLC -and a client acct #.

Tim, thanks.

I'm writing the DV letter as we speak.  I think I have seen somewhere on this site for DH not to sign the letter, just type his name...Correct?

Re: Help, just received a letter from a CA!

OK- Yes do not sign

Hoffe & Associates is also CA - I assume they must not be licensed in your state or some other reason they did not contact you directly-

Now it is more likely this is junk debt- but I think it will just go away with the DV letter-

Re: Help, just received a letter from a CA!

Yeah, we are thinking so too Tim.  DH paid off all badies 5 years ago and in Missouri SOL is 10 years for a written contract and 5 for accounts and such.  DH had this account before we met...9 years ago.

I have a friend I just turned on to this site...you all are so helpful!!

THANKS!!
