I'm ready to submit!

Ha!  I'm finally finished compiling all of my proofs against Sun Trust Bank, and hope to get it all off to the attorney by Friday.  (My daughter needs my car this week ... so.... Smiley Happy  The binder I have organized it all into, is now some two inches thick!  It contains all copies of each and every credit alert received that pertains to this account, as well as all correspondence received from Sun Trust and the CRAS, as of late.

Of course, the only correspondence I've received from the CRAS are the verifications, supporting Sun Trust's claims that I am currently in arrears, which of course I am not.    I even managed to get Sun Trust to send two letters, on their letterheads, which state they are in the process of updating/correcting the information with the CRAS.  I don't suppose it matters that the letters are rather evasive, and I fear the Bad Debt/Collection status will remain the same.  The letter reads as follows:

Dear . .................:

We are in the process of notifying all three of the credit bureaus to advise that the above referenced account should accurately be reflected as charged off, paid in full as of 09/08/2004.  (Will this go into the status bar, or will it remain in the comments, not changing the current status as Bad Debt/Collection?  We'll see!  Also, will this keep newly reported/current late payments and recent/new charge offs from appearing and wrecking the scores?  I doubt it.  There is nothing in this letter that suggests the same, or that acknowledges that Sun Trust reports erroneous information.  Evasive, indeed!  Remember, the DOLA on this account was 11/2002.  The charge off occurred 02/2003.  I paid this charge off, in full, on 09/2004). Upon their receipt of the updated information from us, the Credit Bureaus are responsible for updating your account with the information that we provide them.  Please use this letter as a reference for your account until the request update has been processed by the bureaus.

You may contact the credit bureaus directly at the telephone numbers listed below:

                                                                                     Experian:  800-525-0689
                                                                                     Equifax:    800-685-1111
                                                                                     TransUnion:   800-916-8800

If you have any additional questions or concerns, please contact us at the number listed below.

Sincerely,

so on and so forth.

I, indeed, attempted to contact them, regarding this letter, and faxed them some 11 sheets validating their erroneous reporting, in an attempt to get them to acknowledge the fact.  They sent me the same (above) letter, in response.  They have yet to respond to my DV letter.

When I called the referenced number, yesterday, I was unable to speak with someone, in particular, Mr. XXXXX, as they have just (recently) changed the way one is able to dispute with them.  Now you are not able to speak to anyone, it would seem,  about a decrepency.  A recording comes on telling you to either contact the CRAS or write to Sun Trust Bank, providing proof of your identity as well as proof of the decrepency.

It would be interesting to know just how many disputes they've got going that would have prompted them to change the way they do disputes.  There must be many.

Couldn't have done this without you guys!  And I thank you!

Ahhhh!  I know, Tusc.  I hit tab, again.  Had to edit.  It's habitual, you know?  By the way, I've got my sons working on that math problem of yours.  Smiley Happy  They're attempting to define some of the symbols they aren't familiar with.  Smiley Surprised)  They're having a good time!  Just don't tell me that it can't be solved, huh?

Re: I'm ready to submit!

P.S.  :-)

'Forgot to mention (i so hate to use the word "I" so repeatedly) that the letter received from BOA,  yesterday, regarding the interest rate hike due to Sun Trust's recent reporting to the CRAs, in particular TransUnion, was the last thing to go in the binder.  So now, I submit, and we'll see.  All I want is the opportunity to prove myself credit worthy.  That's all.

Re: I'm ready to submit!

O thank God and pass the gravy!  I don't have to sue!  Called Sun Trust and the CRAS yesterday, figuring I'd give it one last shot (you know I don't like to be mean to people, right?) and told the Rep at Equifax to PLEASE, just one more time, LOOK AT THE 81 MONTH HISTORY THAT SHOWS A NEW CHARGE OFF DATED 04/07 and she did. After telling her, and with much regret, that I would probably be suing if they didn't get it fixed, she told me to give them 2-3 days.   I then called the bank and asked if they had even looked at my last fax, and though the rep said he did, he did not -- the fax that showed three newly reported charge offs within an 18 month period, three years after the debt was paid in full. He told me to give him another week, and I told him, NO WAY. I'd already given them more than a year!  It was going to be within 24 hours or I was submitting my proofs to my attorney.  Now I want you to get a load of my credit scores today, and I am told that they aren't even finished correcting my file, as yet!  I'm so happy, Tuscani!

These are all FICOS:  Equifax:  662!  Experian:  673!  Transunion: 687!  HOORAY!!!

Re: I'm ready to submit!

Thank you, Princess!  This is such a relief -- after a year spent fighting these people -- and especially having worked so hard, for 4 long years, and not having made one, not one, single late payment -- I could just cry!  Smiley Happy
