I have started to get advertisment letters from attornys stating that a garnisment has been sent to my employer from Capital one.The sol has run out and this account has been removed from my credit reports so i pulled my credit report just to see had any collection company been snooping around and yet to behold i see a collection agency called VeriFacts, Inc.has did a hard pull on my transunion report is there anything i can do about them pulling my credit report with out my permission and i know for a fact this Capital one account is very very old.
This was the same tacted AFNI tried to do to me by trying to collect on an outdated account please someone tell me if they have violated some kind rule so i can sue that $#@ they have not contacted me or let me know that a garnisment has been sent all i have is the credit inqury,please let me know if it is some i can do before these fools drop my credit score any lower this hard pull drop me some points and i have worked to hard to get my credit by to standards to let these garbage dwellers ruin it.....Please help fico fam
In most states if not all of them, You must be served a summons to appear before a judgment is issued. You need a judgment in order to garnish wages.
Check the state resource.
Mail a DV CMRRR along with the past SOL and the NO PP letter.
Thank you.....who do i send this to because i have not gotten anything from anyone yet i just got a couple of advertisment from lawyer claiming that someone has has filed papers for my check to be garnished and i pull my credit report and saw verfacts was the only agency who has done a recent pull,so do i wait until i get something.
captiol one took me to court back in 2003 can they come back and try to collect on the same debt even if the sol is gone
If they took you to court in 2003 and won then they may be able to garnish your wages. You need to check your state law on this!!
Each state has their own laws on this. As to your CR a judgment can remain 7 years from the date it was filed.
So you would be within that time IF that is the SOL used in this case.
