Is this collection valid? newb here so I could be wrong.HELP!!!

Hi all,

As of sept '07 I've had a Verizon acct I opened up in 2002/03 show up as a collection. Going by the actual date opened this is well past SOL.

However, the Date acct opened shows up as 6/2007. Is this even valid?

I read somewhere that NCO collections got sued for exactly this practice where they stated invalid Date Account Opened.

You can have a look at the link here, Ive posted a snapshot of this account from my Credit Report.

If it is valid, what would be my next step? Should I send a DV or some other letter. Please advice as I am desperate to get this off my report!!!


In addition, I have lodged a dispute with experian as "Never opened account in 2007".

I'd check directly with each CR (2 of the 3 anyway) and see what their expected removal date is. If it says 2014, well, it has been re-aged. 9/07 could be an update date.

The CRA states that the account is scheduled to continue on record till 2010.

In that case, what would be my next case since the OC took 5 years to put this to collection and never contacted me about it. In NH where the acct was opened is 3 yrs and in MA where I reside its 4 yrs.

So should I DV these people?

Based on that info, you are past SOL.
 
I'd DV since it'll stay on your reports until 2010.

So the Date Opened is not incorrect then?

And if I recall correctly, being past SOL is a good thing right since they cant sue/get judgment on me?

So I should DV them and if they provide validation then do a PFD?

Right...the date listed is the date the CA took over the account and has nothing to do with SOL. SOL is a good thing. You can't be sued.
 
I'd dispute via each CRA and, at the same time, DV them CMRRR.
 
Wait until the results come back from the CRAs (30 days or so later, or less). I'd also wait a little while longer for a response for the DV. CRAs have 30 days but CAs can take their time.
 
If no response over the next couple months, I'd try a PFD.

If I DV them and give them 30 days or so and receive no confirmation/validation I can send a letter to the CRA stating that no verification was received hence the account is invalid right?


Man its hard trying to work with these sc*mbags... !!!

Date opened and date reported have nothing to do with  DOFD or DOLA or the drop date (must be set by the OC under FCRA).
 
If past SOL - definitely DV them.

No, totempole...CA has no limit on time, only CRA. They just have to stop collections, calls, letters, etc until they can validate it. CRA can continue to report so as long as they validated it.

Oh Ok!! Thanks for clearing that up. Trying to learn alotta new things in a short period of time! Serious newb here Smiley Happy

So to sum it all up, I definitely DV them and dispute via CRA at the same time.
