Hey guys,
I need some desperate help. About a year and a half ago, I was involved in a car crash and some girl side swiped me on the highway - my car was the most damaged and I didnt have insurance - anyway - it was her fault but the police office said that the two insurance companies would decide who was at fault. Her insurance co was statefarm - anyway at that time they told me that according to them it was a 50-50 and that everyone would pay their own costs - now the CA calls and said that they determined it was my fault and I need to pay like $2500.00. Is this legal? I am worried because I just cleaned my Credit report and I have been under stress since then. I said that they had the wrong guy but I am worried of going to court or the debt being reported to my CR. What should I do? Should I call them and tell them it was me and settle? Ofcourse if I did this I would get a PFD letter and all that. Please guys guide me so I can tackle this correctly. I cant afford the $2500.00 so whats the best way to negotiate etc?
Do you have a copy of the police report? You may need to get an attorney. I was involve in a fender bender a while back. The officer didn't blame any party. We both had to pay for our own damage. There was much more damage done to her car than mines. About a couple of months later, another driver hit me from behind. His insurance paid for my damages right away. I got very lucky. The damage that was cause by the driver several months prior was paid for by his insurance company too.
If the officer states in the police report each party is not at fault or 50/50, you shouldn't have to pay anything. Get a copy of the police report and get an attorney.

That seems more than a tad dishonest, if not illegal. Why should he have paid for your prior damage?

Nothing illegal Kim. My entire back bumper had to be replaced. Replacing that took care of any damage that was already done to the bumper and back lights. The body shop couldn't just half do the job.

When was this accident and why would any amount be with a CA?
