Re: Judgement Removed

Previous post

I have two judgments myself that are worded as such:

First one.
The judgment rendered herein, having been fully paid and satisfied, it is rendered herein canceled and released. The certificate of judgment appearing in the judgment records of the county common pleas court and having certificate of Judgment NO. 1234 is hereby ordered canceled and released.

CASE Filed 7/29/2004
Default Date 9-14-04
Entry Filed 9-20-04
Dismissal Entry Filed 12-08-04

Second one:
It appearing to the court that the above matter having been fully compromised and settled, the same is hereby dismissed

Are these two results favorable for me to have them removed from the CRAs.

The wording you see in my post is what the courts rendered. They are the last statements on both of my judgments. I was hoping someone here would know if it means that the judgments could be removed from the CRAs. One judgment listed a dismissal date and the other states in writing that it is dismissed.

Re: Judgement Removed

Hi Igdy,
Did you send a letter to get those judgments removed?  If so, how did you word them?  I am wanting to send one but don't really know where to start.  It is from 8/01 and it should drop off this year but you never know.  It is only $65 so I wonder if it would be much of a problem to get taken off.  If you could let me know what you said in your letter, I would appreciate it much.

Re: Judgement Removed

Okay, so just to confirm the process: 1. Sometime before paying the judgment off and if in good standing with CA, you get the CA to file non-suit letter with the court. 2. Then, once that got on you court records, YOU filed a motion to vacate the judgment with the court. Question 1: Did you get the agreement btwn you and CA that they would file non suit in writing? Or was that even necessary since you were in good standing. Question 2: If you got a letter, would you be okay providing a copy here? Question 3: After filing motion to vacate, did you then contact TU, EXP, and EQ to have removed via dispute? Thanks!

Re: Judgement Removed

Dear Concorduser, I've learned that the "Voluntary Non Suit" letter is only valid if it is initiated BEFORE the judgment is final. Is this correct?

Re: Judgement Removed

What do you do if the judgment was discharged in your BK?  If you let the CRA know that it is no longer valid, do they update the date and thereby keep in on your credit report longer.  I have 1 coming off in 4/09 and another one in 4/11.  The 4/11 is only showing on equifax.  The 4/09 is on both experian and equifax.  TU deleted everything.

Re: Judgement Removed

Just to let you know guys, there are alot of CAs out there that will not cooperate with any requests to remove judgemements. They will only report to the CRAs that the account was settled and paid in full. The rest is up to you.

Sad but true.

Re: Judgement Removed

My judgment was removed on two CRAs they never reported it in one

One that I was about to dispute was removed before I even disputed it (I was about to dispute it because of wrong Case Number and no information to response to).

The other one was removed when I disputed it as have no knowledge of the judgment against me and information to response to.

This was a default judgment

Now, I believe it was removed because the CA never verified it.

However, the judgment (which I never paid) has been updated in the Superior Court with interest still accumulating.

I am happy it disappeared, but I am still trying to vacate the judgment, as it can haunt me in the future.

I found out from one website that it is illegal for CAs to file judgment against a debtor that they don't have a direct contract with.

The CA (according to the file) have never presented a signed copy of their purchase of my credit from the OC. The only proof they have about me owing over $10K is a computer print out that can be faked.

From $10K it is now almost $17K. I intend to fight this to be vacated. I just cannot afford a lawyer at this point, and I am afraid that if I try to represent myself then I might mess up as I am not a lawyer. I am googling everywhere to get enough documentation to show the precedence of my case to the court.

HELP, HELP, HELP and ANY HELP will be greatly appreciated.

Judgement Help:

Back in 2003 I rented a room at a house that was near a college campus.  Decent rooomates, setup was we each rented direct from landlord, utilities included.  Times got tough, and the landlord started taking some sub par tennants...  i.e. tweakers, thieves, at one point we had the police raiding the place looking for a tennant.

My company offered me a promotion and relocation, so I gave 30 days notice, payed rent, and left.  It was before the end of the lease.

Landlord apparantly served someone (not me, I was in Phoenix) with papers and got a judgement against me for $2,000 for alleged wear and tear of common areas since I was a no show.

Now here I am with a Judgement.  It is dated 9-2004.  So, my questions:

How long will that Judgement stay on my credit report?

Does paying it make a difference?

How much does it affect my credit report?

It only shows on Equifax; Should I be worried that it will show up on the other two?

Do I have any legal recourse to appeal this much later?

I live in CA but the Judgement is WA, any info on SOL?

Any help appreciated, thanks.
