Judgement in the mail

My wife just got a judgement in the mail saying they are going to garnish her paycheck for $2100.  Is there anything we can do about this?  Can I contact them and try to arrange a payment plan?  Also once this is paid for is there a way to get it off of her credit report?

I don't think you can do anything once it goes as far as judgment. but I also believe paid judgements come off reports don't they? becuase the collection account will still be there.

Re: Judgement in the mail

Paid Judgements dont just get removed. Did you go to court or get served. If not you have a chance of getting it vacated. I would check in to that. Was there any papers sent where you have to list your income or assests. My 18 yr old son just went through that over an 130.00 judgement a woman got against him for hitting her mailbox when he wrecked his car.
I filled out the paper for him since he is still in school and dont own anything. maybe you can do a hard ship kind of thing.
Good luck and keep us posted

Re: Judgement in the mail

No, me and my wife had no idea about this one.  It just popped up under the public section of the credit report and a couple days ago we got a letter in the mail saying they were going to garnish my wifes check.  They have already started the garnish and the amount already came out of her check.  Can they do this with out us even knowing about it?

Re: Judgement in the mail

Sounds like they got a judgement by default meaning you did not show up. Were you served papers to go to court either by the Police/Sheriff or by Certified Mail. If not you need to call an Attorney. Wells Fargo did that to us and come to find out it was their fault because they sent our check back to us and said we over paid. They got the Judgement because we did not get served and took over 2000.00 out of our checking account and all we owed was 917.29 but they got court cost and Attorney fees. I was just lucky were had a good relationship with our bank and they covered all the Checks we had out and we were able to make payments on it. I contacted an Attorney and Wells Fargo refunded all but the 917.29 we did owe and agreed to get the Judgement removed so we would not sue them. I still have it on Equifax they refuse to delete until 2009. Good luck with this and keep us posted.

Re: Judgement in the mail

My husband had  judgement on his credit report from a corporate account.  He paid it but it stayed on there 7 years and then just fell off.
