I'm sorry if this has been answered before, but I have a paid judgment from 2011 that is due to fall off in 2018. It's reporting through equifax now after disputing as paid/satisfied/dismissed/release. I was told the only way I could legally get it removed from my credit reports before the due to fall off time is to get a record of expungement from the court, basically stating that the judgement is not mine. Is this true? Is there another way out of this? I know a judgment will severely damage your score, and I want it off, like now lol
Record of expungment, getting it vacated are the same thing. You want to see about vacating it on grounds that its been paid, you would file the motion in the court that granted the judgment. Some states allow this, you can find out the reasons a judgment can be vacated in your states codified laws that govern how the civil court system works. You would not be asking for it to be vacated on grounds it isnt yours as that would not be true and would be a false statement to a court of law.
That what I was told too. But I am the exception. I just paid my judgement last summer and a few months later it didnt update as paid
so I disputed it, and amazingly, it was deleted. That was a GOD SEND.
PS This also happened with my chapter 7.... I only disputed an aspect of the record and it was deleted.
Paying a judgment does not create any inaccuracy in credit reporting that would be basis for requiring deletion of the judgment.
You had a clear anomoly if they deleted.
For others attempting to use a dispute as basis for deletin of a judgment, you have the burden in any dispute to proivde a statement of an inaccuracy, and some documentation that is adequate basis for compelling an invesitigation of its accuracy.
If the judgment is legit, a dispute can simply be dismissed or verified.
A dispute becomes legit if the court has vacated the judgment, and yet the CRA has not picked up the vacature, and thus not yet deleted. Not the usual situation.....
well the judgement had been paid but was showing not paid so I disputed to get an updated
and it came back deleted.. and YES I was wildy surprised. I did upload the letter from
the lawyer that said it was paid.
The bankruptcy was also deleted a few months early but no biggy there.
I think I used the online dispute. I'm sure mine is the exception
as the lawyer and county sherrif wouldn't help me at all.
