Judgment 101

To all those with experience in Judgments, I have a request. I am writing a primer for credit report maintenance to be posted here for all of those who wish to legally correct their credit reports. I am looking for the correct, way of increasing your FICO score by dealing with Judgments. (I plan to cover all of the other topics as well).

Judgments:
If the judgment is over 7 years (15 for government), but still reporting on your CR, how do you go about getting it removed? Do you simply dispute with the CRAs? If so, what statutes can be quoted to encourage them to remove it? Do you have a sample letter for people to use?

If the judgment is not yours, how do you go about requesting it be validated? Can a DV letter be used? Do you dispute it with the CRAs and DV the judgment filer at the same time? What if the filer is the OC?

If the judgment is yours and less than 7 years (15 gov) and you wish to settle the debt, what is the best method to benefit the FICO score the best? Can you send a PFD on a judgment? If yes, can it be assumed that only PIF / PFD would be accepted? Are we out of our minds thinking that a PFD will work on a judgment?

If you have already settled the judgment, is there a snowball's chance that you can do a GW letter to get it removed?

Can you describe how to get a judgment vacated? Does it ever work?

Getting the judgement is a big plus for scores. Make sure the creditor / CA files a nonsuit with the court and ask the judge to dismiss the case. Then the judgment can be removed from CR. Talk to you local atty about this and also look up on the internet and search for nonsuit. Good Luck.

The process is simple, if you still owe money. If it's been paid, then you have to wait. Although you could file a Vacate Judgment filing in any event, but you'll need to have quality language to get the judge to take it off. Also, if the Defendant (the old Plaintiff who sued you) fails to appear, then you get the default judgment against them.

It's all about negotiating a settlement that includes filing Nonsuit or Lawsuit Dismissal paperwork as part of the payment. Whether or not the OC/CA will agree to that is the issue, but if they want their money they'll probably do something. And it pays to settle as close to the 100% of the balance as possible, so the OC/CA doesn't feel like they're doing you such a big favor.

I am not sure if I am of any help, but what I did today is check the judgment filed against me. I found out that the CA was reporting a different judgment case number on EX which I will contest ASAP.

I checked the correct case number which I got from other 2 CRA - they have deleted the judgment on TU and never reported the judgment on EQ.

I found out that the court asked the CA return the writ and they never did this, they must have been lazy or something.

That was why they thought they try to collect just the interest from me which was not noted as WRIT RETURNED.

My thoughts is that you check the public records to see if they have done something illegal? If not, I guess you have to PFD
