Have a judgment in favor of Great Seneca Financial. Contacted the attorney to settle, they advise that they no longer have the file, its been sent back to the plaintiff. Searched long and hard, no phone numbers to be found that work for Great Seneca Financial, so called the attorney back to see if they have contact info. She advised that the judgment was actually done through a company called Axiant, which is now bankrupt, so they dont have any contact info for either. I am at a loss. We need to get this item settled, but cannot find anyone to work with. Based on the fact that the attorney won't work the case and Axiant is bankruptcy, do I have any recourse to get this dismissed? If so, does anyone know what steps I need to take? Thank you in advance.
Most court clerks aren't strangers to situations like this. In many jurisdictions you can go into the court clerk's office and document your actual inability to contact the judgment creditor. The court clerk will then let you post a bond in the amount of the judgment and then mark your judgment as satisfied. The court clerk then holds the money until such time as the original judgment creditor contacts the court or, failing that, until a certaion period of time has lapsed and the money then escheats to the state.
