A collection shows up on credit report and it reports monthly KD.

 

Original credit does not show anything on the report.

 

The collection company has not sent anything.   I suspect this goes back to 06/05 when I had an alarm system put in the house.   The thing  never worked right.  Original company gave me a full refund.   The company went belly up and sold to another company.   The new company started billing me.  I disptued this since they were NOT provided a service.  Showed them a copy of hte refund check.   They promptely added the refund into the current amount due.

 

Then the silent treatment began.  The system was definitely NOT working at all.  Not even the emergency call for help.   Nada.

 

In 09/06, harassment from anomyous callers began.  Numbers showed up as "private" or "unknown".   Threatening messages were left, but no contact information to return the call.    If I took the call they refused to tell me who they were or how to reach them.  Eventually they stopped after a few months after I had an authority figure answer one of the those nasty calls.   

 

In 09/10 (according to crdit report) a collection company is reporting something.

 

Date opened - 9/1/2010

Account status - Closed

Payment status -  Seriously past due date / assigned to attorney, collection agency, or credit grantor's internal collection department

Terms - 1 Month

 

In 09/10 - things start reporting as eitehr KD or ND in the payment history.   Last update 01/12.

 

1.   No communication since 06 (same company now reporting??).

2.   If the account is closed, why are they reporting as recently as this month?

3.   Is there a date of default since the original company refunded all of my money and the new company added the refund back into what was due?

4.   Can this be disputed and taken off?

5.   There is no estimated date of fall off on my report.

 

Please help.

They are clearly already in violation of one or more provisions of the FDCPA.

Posting to your CR invoked their obligation under FDCPA 809(a) to have sent you written dunning notice within 5 days thereafter.

Calling and using any form of harassment listed under FDCPA 806.

 

Their failure to have sent dunning notice is particularly egregious since they have posted to your CR, and have not provided you timely notice of their identity so that you can begin actions to address their reporting.  Damage to you is the continuing harm to your FICO score and the viewing of the collection by others, without providing you recourse to challenge it.

 

If you can get their address, dont wait for a dunning notice.  DV them immediately, thus placing an automatice cease collection bar on them.

That bar extends beyond a simple cease communications letter under FDCPA 805(c) until they provide verification, so there is no immediate need to send a cease communications letter. 

 

They are apparently attempting to collect time-barred debt, as I assume SOL has expired.  Nothing illegal with that per se, but if SOL has expired, you have no legal obligation for the debt regardless of whether it is or was accurate, so you dont have to re-fight that battle.  Their problem is the damage done to your CR and scoring, and that is illegal without providing timely notice to you of their collection actions.
