LVNV Funding again...

I have been trying to clean-up my hubby's credit and noticed LVNV Funding on the CR as a new TL.  It is a collection account from OC GEMB/JCPenney $508. It is scheduled to be removed 11/09.  We have not any rec'd any calls or letter regarding this account.  Should I DV and awake the monsters? I am currently repaying a debt to LVNV for a repo.  Unfortunatley, I was not familar with this forum then.
 
We are looking to purchase a home within the next 6-9 months.

Before doing anything   check your SOL!!!   It should be past SOL  but make sure. Then they can not file suit & If they get paid you are in good standing for a PFD.
 
If past SOL  DV them  CMRRR

LVNV are Nazi's.
 
I have been fighting them on an old Auto Repo they bought from the Original Creditor for off and on almost 2 years. Debt is now going on 7 Years.
 
Then I found the myFICO and got a good DV letter as an example to use. Currently in the DV process right now but I also copied the 2 CRA's that are still listing LVNV as validated with the DV letters.
 
These guys do little else but look at their Database that they bought from someone else and use that as Debt Validation to the CRA's.
 
If the CRA's are copied on what the Debt Validation letters explaining what the legal requirements are; and that you are aware of them; and that the SOL is over; ...whew... ;then you have a chance they might drop it and go to greener pastures.
 
Still waiting on mine 5 days into DV process.

Thanks.  The SOL is 3 years in SC for everything. I will give it a try.
 
My scores have increased 40-60 points in the last 4 months.  Still a long ways to go...before I can purchase my home.

Resurgent is a manager and servicer of domestic and international consumer debt portfolios for credit grantors and debt buyers, and has been hired by LVNV Funding to perform these services on its behalf. Resurgent, a licensed debt collector, may perform these activities directly, or in many cases, will outsource the recovery activities to other specialized, licensed collection agencies. Looks like LVNV Funding, LLC has themselves shielded by 2 Layers of bureaucracy from the actual CA doing the collection activities. However their name is the one appearing on the reports so it is their liability.

I'd like to know what happens too...they ignored my DV, my SOL is up this year, but I actually had a hearing w/the third "local" CA, then they pulled the Summary Judgment, they were awarded "partial" judgment, so we have a hearing starting end of April to determine amount.
 
What I don't get is we are required to try mediation and they have made NO contact since one offer of $1500 (my original debt was $1300), and I know they only paid about $13-$20 for the stinking account.
 
What happened two weeks ago - they "closed" the account on TU, and it shows closed on EX, but EQ is still reporting it so I don't know what the heck is going on?!
