MAF leaves message on DH's cellphone

DH retrieved this message on his cellphone today:  "This is MAF,  and if this is not  D H, immediately hang up,  we are attempting to collect a debt and by your listening to this message you have hereby acknowledged this debt call 1-800 749 7710 to arrange for payment".

This is the first time we have heard of these people, they are not on DH's reports.  I googled the name and located their website MAF Collections.  They do have fax #s listed.

I would like to immediately send them some type of cease and desist including the section 809 info.

Any suggestions?

I really don't want to put my address, as they may use it for changing their records.  I used my cell phone and called the number - it said to press 1 to pay, otherwise hold for customer service.  Of course I did not press 1, held for about 30 seconds and it disconnected me!

Hmmmm, guess my numbers not on their list.

They are full of crap!!!! Just because you answered and listen to the message means that you accept the debt. Too funny. If you haven't already SAVE that call.  It is illegal. They must talk to the person whos debt it is or by mail. NO message can be left even hinting at a debt.

What I would do is forget it. Make them mail it. The law says that they must communicate....leaving a message is not doing that.

does your DH have his name and voice on this?? If he does remove it!!!!  just say sorry not available please leave a message.

You should not have returned the call. Now they have whatever phone # you called from.

It is up to you weather you contact them or not, BUT I think if they were within SOL or CRTP they would have left a much better message. A legal one.

Speaking for myself...I know who I owe from way back & who I do not.So when I get any calls like this I just ignore them until & if they hit my CR. At which time I go after them.

You might make a list of all creditors that you can think of that might be within SOL or CRTP. Ask DH who he can think of. That might give you an idea if something is outstanding.

Remember if it isn't on you CR as an OC  CO, there is a good chance that it is past everything. Don't forget medical bills usually get turned over to CAs as hosp.and doctors usually do not report.

ALSO  check & see if CAs must be licensed, registered or bonded in your state. If they must, see if MAF is.  They can not collect if their are not.

Re: MAF leaves message on DH's cellphone

Thank you Happy!

I called them back from my phone, it's new and doesn't have any names on it and not connected to DH's at all,  I only received a recorded message, no actual person.  DH was severely upset.  I told him not to answer it if they call back.

Weird, a couple days ago we had responded to a pre-approval for  First Equity, first app for credit in almost 8 years.  On the call back number, First Equity had to put a three way call to DH's cell for verification.  His cell is a fairly new number.  Of course, after the conversation, they said they would send us a letter in the mail.  I'm sure we were turned down. AH's.

DH has a BoFa that will be (should be) dropped from credit report in March 08.   Midland Credit bought the debt and changed the reporting.  Don't know if it's them.  I am going to try and research to see if the principals of First Equity and Midland are tied in somehow.

No one has DH's cell number.

Re: MAF leaves message on DH's cellphone

Of all the scum-sucking oxygen relay devices out there, MAF actually isn't that bad.

I just had a collection that I paid off in 2003 be deleted from my CRs because I sent them 1 GW letter.

Follow the board's advice.  Do NOTHING until they notify you in writing.  If they pop up on your CRs they are in violation.  Dispute it with the CRAs as not yours since they did not notify you in writing or record a conversation where your DH talked to them.

Good luck.  Keep your CRs to enfore DOLA if they do try to collect for an OC.
