MIDLAND CREDIT MANAGEMENT

I am having the hardest time disputing Midland. they sold the account to Jefferson systems who in turn sold it to another company. They refuse to send me a letter in the mail or fax. They will not remove it. Any advide or ideas on how to get it removed.

Could you tell us a little more about the debt?

 

1.  Was this a valid debt?

2.  Was it paid?

3.  What part do you want dropped from your credit report?

 

Any other information you can think of would be great.

First off, stop disputing. There are better ways to get a baddie removed.

 

IOBA has some good questions. I'd like to add to it:

 

How do you know that Midland sold the debt? Typically, if sold, a CA will delete themselves. Are there any other CAs reporting on this debt, like Jefferson?

 

When is the DOFD?

 

Are you out of SOL? If not out of SOL, do you have the ability to PIF if you had to (assuming it is unpaid)?

 

What letter are you asking for from them?

The OC wasHSBC/CC. The debt is valid. the balance was last reported as$0 with OC. it was sold to MIdland, after pulling my bureaus, i contacted Midland informed me they no longer serviced the account that it was transferred to jefferson/Compu credit. when i contacted Jefferson/Compu they offered a settlement of $414 and paid in full if I agreed to sign up with their Fresh Start Solution Program, which means a credit card with a balance of $185. I rejected the offer and they refused payment. Jefferson is nt reporting on bureaus. Midland will not report they sold account. it is reportng i owe them Im trying to resolve it to purchase a home. i requested a letter validating debt, they refused to send anything. once a CA sells to another should it be deleted ff the bureaus.

1.   Midland may still owe the debt, but is allowing the other company to collect on it.

2.   Contact Midland and pay them directly.  You can ask for a pay for delete.

3.   If Midland says they do not own the debt, ask for a fax that clearly states that they had the debt, sold the debt, who they sold the debt to, the date of the sale, and contact information for the debt owner.

4.   Once you have this letter, contact Midland again, and remind them that since they do not own the debt, they can not report it on your credit reports.  Ask nicely that they remove it from all three cb's immediately.  Ask nicely for a letter confirming their intent/their actions.

5.   Go to the new debt owner.  Ask nicely if there is a way to pay the debt on line (and for instructions) and ask nicely for a mailing address.  

6.   Pay the debt.  Get something as a receipt to show that the debt is paid in full.

 

The letter from Midland showing that the debt has sold can be giving to your lender/underwriter.

The receipt showing the debt has been paid to the current debt owner can be giving to your lender/underwriter.

I bet Midland still owns it also. Jefferson is an odd sort. They only buy debts if you accept their CC offer. Midland is passing the buck because they get a cut if you sign onto that CC program. Jefferson makes money, Midland sells a debt, and you get a CC with a high rate and fees that'll get closed down within a year. That's their SOP. If you search in Credit in the News for Jefferson, you'll see some FDIC and FTC filings against them detailing this operation. Don't call MCM, but keep hammering them with DVs and you may have to switch up the language on the DV to sound a little more threatening. MCM will cave.
