FINally. Anyone who has followed my travails since December knows the ridiculous amount of steps and $ I went through with them. 4 Disputes, 2 MOVs, 3 sets of faxes AND 2 sets of Emails to CEOs, CFOs, In House Counsel, documented letters from OC that 'Not Mine', receipts of Midlands signature on Certified Mail, copies of the letter to them over and over and over and to everyone, two FTC complaints, one BBB complaint, follow-ups with both, calls and faxes to HSBC (OC) over and over and over again to get them to get it off.

I just got a reply from Midland through BBB that in 'accordance with our policy to act affirmatively to consumer issues'... pardon for one second... HAHAHHAHAHAHAHAHAHAHAHAHAHAHAHAHAHAHAHAHAHAHAHAHAHAHAHHAHAHAHHHHHHHHHHHHAAAAAAAHAHAHAHAHHAHAHAHAHAAA

they decided to cease all collections and instruct the CRAs to remove.

MAN! OH! MAN!

Now all I have after the mess this report was last year (500s) is the Cap1 that falls off in September. I'm hoping my 700 Efax and 705 TU jump at least 30 once the 120 Day Late Unpaid Collection reported as of one month ago is gone.

YEEEEEEEHAH!

WTG! I know how hard you've worked at this.  And I know I don't have to remind you to check the CRs to make sure they actually do what they said they would do!  Congrats again.  Persistence does pay off. Smiley Happy

Oooh yeah I am going to be on it. In fact BBB said if we don't hear from you in 14 days we close this, so I am going to reply as nicely as possible 'Thanks BBB/Midland. I will gladly close this case when the items are removed from my Credit Reports as Midland promises" Now too bad there isn't an icon for a sweet **bleep** you smile.

Replied 'No, did not resolve' to the reply. Said I appreciated their reply but would close when the CRAs stopped reporting as per Midland's promise. Their letter was dated 6/06, just updated today 6/10. MAN can't wait for that 5/15 120 Day Late $1800 Charge Off Collection to go. Any guesses where 705 goes to?

Good for you, NY!!  I've followed your saga and shared your frustration!
 
Dealing with a Midland issue myself.  Reported to EQ and TU even though their colleciton letter advised they would not for 30 days allowing me to ask for DV.  Atty sent DV letter, they signed on 14th of May and reported on 16th!!
 
Atty has taken them to court numerous times so knew who to call.  Midland sent letter (obviously a form letter as the date was Aug 24, 2007!!) but they showed it sent by mail and fax and the letter was faxed 5-30) advising "in light of threat of litigation" they would cease immediately  all collection activity until DV.
 
They have until the 14th to get the DV to the atty, which he doesnt really think they'll do but we'll see. Their "ceasing" is supposed to include deleting from reports, but I've not pulled them yet to see.  Reported to TU as collection and to EQ  as  account 120+ days past due.
 
When you say they updated 6-10, do you mean they already took it  off your report or is that what you're  waiting for?  I'm a little dense sometimes so not quite sure what you meant. 
 
Just curious how long (if they do delete) before I'll see this on my reports?  I have scorewatch but alerts have really not been coming as they should have...didnt even get one when this collection/acct was added!!  Just happened to pull report!  So dont want to spend the money to pull report if it hasnt been enough time yet.
 
Again, very happy for you with your success..especially since you were a totally innocent party subjected to their slime tactics!!!!

Amazing company. I loved their letter to the BBB.

Their letter was dated 6/10, checked TrueCredit today they are still reporting.

So I replied 'Not Resolved' and said I would reply 'Resolved' when the CRAs stop reporting. Sure Midland will say they don't control, however when IC Systems wrote me they'd remove, it was off in 5 days.

I don't know whether to laugh at that or throw up!! 
 
Just like in my initial letter, "we will not report if we are not already doing so"......right! 
 
That's why they reported it the day after signing the DV letter?!?  And when I called the atty on May 21st and he called them, their registered agent assured him it would be removed immediately. LIARS!
 
I am so hoping they send nothing back  and leave it on my report so we can sue them!!  Can't wait for the 15th to get here!
 
They're such slimes, though, they'll probably send some garbage DV just to keep the thing open longer.   And I really, really want this off my report! 
 
Atty doesnt seem too worried as he's dealt with them so many times, and as he said, they dont follow the rules and dont worry themselves about suits...they just look at it as the cost of doing business. I just hope we can nail them for all our sakes!!  My atty (also a judge) has done a lot of consumer advocy work involving credit  and  was involved with writing, issuing opinions etc on some credit laws in our state and federally (is that a word?) so feel confident we'll get this resolved, but it is so frustrating and maddening!!
 
Guess I wont waste money pulling my FICOS yet!!

The name of the game is extortion; how many people are going to do this, sue, etc? One lost court case for 1,000 $500 collections?

Knowing them is the reason I did not reply to the BBB 'Yes this resolved it' (as Midland I am sure expected) but 'No' and said 'Midland is still reporting and I will be glad to close this case to their satisfaction as soon as they are removed from my reports')

Sure Midland will say 90 days not their responsibility bla bla bla but I've had other lines (IC Systems) come off 5 days after they said they'd do it.

IF Midland sends BBB and me a copy of the letter they sent/sent CRAs then I'll close the case.

just a follow-up; this is a nice checkmate move in BBB land; Midland can't change their mind and NOT pull just because I said I'd close when they DID remove as they just promised BBB they would and they can't NOT remove since they said they would. Well they CAN but I think they'd get a BBBBeye Smiley Happy
