Midland Credit Response to Dispute... Next Chess Move Is?

I disputed a TL that MCM had on me that dates back to 04 (OC being Pacific Bell, do they even exist anymore?) back when I first found about myFICO on Aug. 3rd/07.

They claim I owe $142 from a phone bill, that I clearly remember paying. Although I don't have those canceled checks anymore.

Here is MCM's response that came to a PO Box that I have, not the address I requested information on this matter to be sent to, so it's close to a 30 Day window since they responded to me...


"The purpose of this letter is to request your assistance so that we may reach a quick resolution to your dispute.

We are attempting to verify your dispute and it would be helpful to have a copy of any documentation you may have that substantiates your dispute. In the interim, we have requested that the three major consumer credit reporting agencies change the status of this account to "Disputed."*

Please mail or fax canceled checks, paid letters, police reports to (800) 306-4443 Attention: Consumer Relations.

We can be reached at (800) 825-8131 ext 2980, should you have any further questions.

Please understand this communication is from a debt collector. This is an attempt to collect a debt. Any information will be used for that purpose.

* Your credit report will not be updated if the federal reporting period has expired, or we have not previously reported on this account.

As required by law, you are hereby notified that a negative credit report reflecting on your credit record maybe submitted to a credit-reporting agency if you fail to fulfill the terms of your credit obligations."


It seems to me that they're having a problem verifying any information on me. What should my next move be?

Ok  you disputed with CRA   correct   did you send a DV to the CA......if not send it NOW..CMRRR
 
I wouldn't even answer their letter  and NEVER talk to them on the phone!!!

Hey, I've tried disputing an account with Midland and they never responded to me.  I sent them a copy of the cashiers check that paid the account with First Consumer National Bank wayyyyyyy back in 2001.  I disputed with the CRA and sent copies of the cashiers check to them as well.  Experian is the only one that deleted it, should I try with the other 2 again?  This is nerve racking!!

# 1 RULE....you NEVER deal with any CA by phone, mail, or send  them any info! By sending a DV   They MUST send info. to you. They must prove that it is YOU that owes.
 
 IF they are on you CR:
 
First you dispute with CRA
Second (same time)  send a DV to the CA
 
Always know you SOL before messing with CR (if it is about CO or CA)
 
All DV go CMRRR!

i sent a DV  CMRRR with no response from them.  That's why I sent the copy of cashiers check to CRA hoping that they would at least report it paid, Midland not respond and its removed.  When I did that it was removed from Experian but not the other two.  What do you advise to do next?
 
By the way its scheduled to be removed 05/2008 but I really dont want to wait that long.

that was a mistake!!!!!  if they do not answer DV  within 30 days they must not report or they are in violation.
 
Dispute with both CRAs      as not mine!

I appreciate your advise.  please understand that i am new at this and want to make sure i am within my rights.  i did dispute the account as not mine.  the cra said that it verified the account as mine.  when i called them on the phone a cra rep stated that they only have to verify with my name, any of the addresses on file an ss#.  i informed her that it still wasnt mine.  should i file a complaint with the ftc?

i just pulled out the copies of my reports and EQ reporting bal due, TU not reporting any bal. They are both reporting "acct info disputed by consumer" what does that mean?  Should I dispute again as not mine?

i found the MOV flow chart and will try calling the cra tomorrow and request MOV.  i will let you know what happens!  Thank you soooo much for all the advice.  Credit is so important and the information that is kept on us.  its almost like you have to baby sit your credit reports to ensure that laws are complied with and things are reported correctly.
