Re: Midland Funding LLC, Assignee of Aspire

Then you have to deal with Midland and perhaps W&A.

Since you seem to be able to pay to avoid a judgment - DV W&A and Midland (who is on your CR)

I recently diputed this account with all 3 cra's. It was originally an Aspire card, then Midland bought and when I disputed. I recieved a letter from Wolpoff & Abramson, LLP. They are saying at this time no attorney has viewed this case ,What should I do next?

wolpoff et al have been identified as having serious conflicts in arbitration because they both own the arbitration co. and they represent as attorneys. they do not necessarily tell you this. you may have a lawsuit against them for their conflict etc. under the laws, probably federal i'm not sure.
as for midland, they try anything they can get away with, they are super shady, look for their violations and their lawyers violations so you can countersue or sue them outright. google has plenty of lawyers waiting with their ads, to get you to hire them for the purpose of suing such firms for free.
here's one link for some valuable info.

http://educationcenter2000.com/legal/wolpoff_defense.htm

you may have to copy/ paste it but there it is. just check that site out it's pretty good.
i personally have a lawsuit coming up with midland et al but i will not OBEY them, i will obey the law, which they do not respect or follow. they are not going to steer you where you need to go, get an attorney that will go after them for free.

so now i also have to take my own advice but feel like i'm definitely in warrior mode...will do battle.

Re: Midland Funding LLC, Assignee of Aspire

oh here's the other thing. if the original creditor does not own it any more, maybe they charged it off as bad debt and then either 1) sold it(not supposed to i hear); or 2) Midland picked it up from your credit report and just decided to collect a dead debt if you will agree to it. (deception/ fraud / illegal). I hear that those charged off bad debts are not valid to collect. I'll check that cuz that's exactly what happened to me. I want Midland and those criminals prosecuted as such!!!!!

sandim,

You posted your question in a thread that is really old.  I'm going to suggest that you copy and paste it to the "Rebuilding your Credit" thread.  You'll get far more responses there.  There's lots of help here, I'm sure someone will be along quickly for you!

Good Luck,

D-R
