Midland Update

Hi Everyone,
I just wanted to give everyone an update as to what happened whenever we DV'd CMRRR to Midland.  I explained before that there was no way they could validate because we never had an account with citibank, who they were trying to collect for, so they say.  Well, they never sent debt validation, and all 3 credit reports deleted the info.  This was in January.  We thought it was all over with because we never heard anything from Midland after they signed for the CMRRR on Jan 3.  Yesterday in the mail, what do we get, another Midland bill.  Guess what?  We are off to the attorney to file charges against Midland.  They know they cant validate and are supposed to stop all collection efforts.  Do we need to send a cease all collections letter now or can we just press charges against them?

Two things. Do you have a hard copy of both the credit report that showed the Midland collection and one after the deletion? Are you out from under your state's SOL? If you're not sure, check the links below.

The CRA deleted this account because it is not mine and Midland could not provide DV.  I do not know what the SOL would be because it is not my debt.  I do have the hard copies of the CR before and after the deletions on all 3 CR.  Midland is in vilolation because they can't prove it is a valid debt.  They have to stop trying to collect on a debt that is not legitimate.  This is why I wanted to know if I have to send them a letter telling them to cease all collection actions or if I can just go to an attorney and sue them for violation of my rights.
