Midland and DV !!HELP!!

In my defense I have spent the last four days reading through these forums and I am still confused and need help. I live in Pa now all accounts opened in Fl. I just don't wanna make a costly mistake that can't be fixed. NO lates for three years scores up 60-80 points over last year TU 629 Exp 600
EQ 669 Old college CC's and student loans on credit. No BK, liens, or judgements. Heres what happened:

Old providian CC opened  99

Charged off by Provodian 03

On 10/07 MCM listed this as a new account opened 10/07 for $2,480 on EXP ONLY. crashed my score 50 points on EXP

Also listed on Exp as Presidio for $2,042

I have consolidated my Student loans so they show a zero bal on CR's These two major things are really in my way right now and with them removed my scores could be way up by the end of the year. What do I do? DV, Dispute, who? Presidio? Midland,? BOTH? AAAHHHH!!!!  I see 100 different pieces of advice and 20 form letters and I just don't wanna screw myself. Please help me. I have really cleaned up my act over the last five years and want to buy a home in 2009.

Re: Midland and DV !!HELP!!

What is SOL for both FL and PA on open accounts (assuming cc for all)?  Need to know if SOL for both states is DOFD or DOLA - this is to keep you 'safe' or at least aware that you might get sued.

BTW, SOL cannot resart if the OC has charged-off the account.

DV each CA (Tusc's letter is good).  Lonster should be posting his this afternoon.  Very important to include in any letter that you dispute the validity of the debt.

It is overwhelming to start - but  you do 'adjust' (and learn) the terminology and the ins/outs with time.

Re: Midland and DV !!HELP!!

SOL for Pa where I live is 6 years and Fl where accts opened is four years. On EXP it says sched to continue til 8/10. How can it show an open date of 10/07 if they admit it was charged off in 03? There is no dola or dofd listed. the way it is listed is very vague and obscure. Very little info from MCM on there.

Re: Midland and DV !!HELP!!

ok so EX says it will drop 08/10. this indicates that the account wasn't reaged, and that the date you are seeing as "open date" is just that, the date the COLLECTION account opened with that particular CA. If you can't wait until 08/10 for it to fall off, then you could offer PFD, but you are still within SOL in PA and i'm not sure which SOL takes precidence, so be careful. be ready to pay in full in case they decide to sue, unless you are SURE you are out of SOL.

Re: Midland and DV !!HELP!!

Yes but its not REPORTED as a collection. Its being reported as a new account and my score immediately dropped 50 points with this as the only change in the report. It has to be because of this and that has to be because they are pulling a fast one of some kind. Thank for the response though.

Re: Midland and DV !!HELP!!

so sorry, missed that little detail in the first post. if it were me, and i'm no expert, but i would dispute it as "not mine, did not open new account with this company" and see what happens. i figure the worst is they will move it to the collections section where it will continue to age. what do the pro's think?

Re: Midland and DV !!HELP!!

The creditor can choose what suits them - in this case the longer PA SOL.

Even if you PFD the CA - providian doesn't have to remove theirs (it's accurate).

I would DV the CA (but be prepared just in case) then use the OC program with Providian

Re: Midland and DV !!HELP!!

Providian charged this off in 2003 and are NOT listed on my report. Presidio AND Midland are reporting the same debt originally from Providian so I have 2 neg accounts for one debt. Can they do this?
