Midland did not validate, next step

Hi Everyone,
I sent Midland DV CMRRR, and got the green card back.  It has been 30 days, and no word from them.  Can anyone tell me the proper steps to take next?  I have a consumer lawyer that is 2 miles from me and I think I may consult him, because, I know for a fact this is not my debt and that is why they could not validate.  What would you do?

Send Midland follow up letter CMRRR.

Send dispute to CRA's that Midland failed to validate your dispute. Enclose a copy of your DV, CM receipt, and GC as evidence.

Is Midland still reporting to the CRA's? If so, in your follow up letter, mention they are in violation according to FDCPA. They must cease collection activies, including reporting to the CRA's if they have not validated within 30 days of receiving your DV. Make sure to enclose a copy of GC and the first DV you sent.

Also, be aware they do have the full 30 days to validate.

Re: Midland did not validate, next step

I have almost the same situation you do. Midland has failed to answer a DV I sent them on 1/22. I sent it CMRRR and have the GC. So know I am going to send the CRAs a copy of the letter , a copy of the CM# and a copy of the GC, also telling them that Midland has failed to validate this collection.  I am also going to send Midland a letter saying they are in violation. I didnt think they could validate this debt and they didnt within the 30 day period. I just hope its as easy to get them off of the credit reports, because it is hurting my score.
