NAFS Buffalo...the devil!!

These guys only on my EQ CR they did a soft pull on 11/13/07, then a hard pull on 11/19/07.  Are they checking to see if I'm checking?  They are not even any CA on my CR, I think they contracted Northstar Location Services, because out of nowhere on a really old debt about to fall off my reports in July, I received contact.
 
My question is I want to dispute this hard pull on my reports, don't really want to deal with NAFS can I call or send a letter to CRA?  What should I say in it?  Or do I have to deal with the devil and send them something?
 
OH! Also if renting a car from Hertz, should that be a hard pull, or soft? I have two of them on my CR. Can I send them something, or again ask the CRA?
 
Any help would be appreciated...Thank You!!

I have noticed that you have placed an inquiry on my _________ credit file dated ________. Based on the evidence in my possession, this inquiry was performed under false pretenses as described in the clear language of the law. 15 USC §1681n(a)(1)(B ) states, in part, "in the case of liability of a natural person for obtaining a consumer report under false pretenses or knowingly without a permissible purpose, actual damages sustained by the consumer as a result of the failure or $1,000, whichever is greater;"
 
You are civilly liable to me in the amount of $1,000.00 for your willful violation of the law -- performing a "hard inquiry" on my __________ file without my permission. I do hope that we can settle this matter amicably. You can remove the inquiry within one (1) business day of the receipt of this notice. Or, we can meet in court where you will end up removing the inquiry, paying me the civil liability fine, punitive damages for my score drop, plus court and attorney fees. The choice is up to you.

I am so glad I checked this post.  I received the same pull from these guys and they have been calling my home.  I can I get them to stop that.  I called back b/c the message left no real info and I have nothing to hide, at least I thought.  They stated it was for an auto loan, that should be removed around Nov.  Can they collect for that one the SOL is reached?

The debt never goes away BUT they can try to file suit and your defence is past SOL!
 
Keep in mind that IF the debt was accured in another state  that state may apply.........They can not report on your CR after the CRTP is past!
 
Send them a letter  CMRRR  telling NO phone calls  everything must be in writtin!

I just noticed a hard pull by NAFS Buffalo as well back in January. Did anyone actually send the non-PP letter? What was the result?

I sent it almost one month ago, have not heard anything, and the inquiry is still there, if someone knows of a follow-up step, I would really appreciate it!!

I think you need to follow through with the "you are civilly liable..." part. My guess is that they aren't going to take you seriously until you put some weight behind your words. Get a lawyer to send them a followup letter reiterating your position.

As for me, I am contemplating doing what I suggest for you. My lawyer just finished negotiating a PFD with Cavalry.Cashier's check was just mailed (overnight delivery) on 4/24. In January, not only did NAFS do a hard inquiry they sent me a letter saying they were collecting for Cavalry. During the negotiation with Cavalry they told my lawyer that they own the debt, are collecting themselves (not using an outside collection agency), and have no idea who NAFS Buffalo is.

I'm just waiting for Cavalry to delete and then I'll decide what to do with NAFS Buffalo.

Cavalry deleted and I had my lawyer send NAFS Buffalo a letter asking them to state their permissible purpose or to delete it. That was a week ago, so we'll have to wait and see what happens.

Does anyone else have any progress they would like to report?
