NCO inquiries

I have just started this fico game and I have a question about this collections agency (NCO/Medclear) who has for a small medical bill ($137)  now pulled a hard copy of my credit report from TU 7 times in the last 2 years. The original debt is from 2003 and I would like to send them the permissable purpose letter but was wondering if I should send 7 seperate letters, one for each bad credit report pull or bundle it all up in one. Also, since I do not dispute that this is my debt and have no problem with pif, should I attempt to bargain with them instead via a pfd letter instead? Just don't want to make a bad situation worse.

What were the dates of the INQ's and what state are you in?

I am in Florida, SOL is 5 years I believe. The dates are as follows:

3/20/06
 
all are hard inquiries on TU.

Hi slider, you are really going to start something with that first question! We do not all agree about PP.
 I believe that a CA never has PP to pull hard copies!!!!!  I will send you the letter to mail CMRRR to the CA     make any changes that you need
 
You should ALWAYS DV a CA  before thinking about paying. You need to know several things first & only the CA can tell you.
 
Yes SOL on med is 5 years in Fl.      You would be well past SOL.  BUT not CRTP until 2010

As you probably know, Credit Reporting Agencies treat inquiries as a statement of fact and will not allow a consumer to dispute them. Since it is against federal law (Fair Credit Reporting Act -- 15 USC § 1681n(a)(1)(B) for an entity to view a consumer’s credit report without a "permissible purpose," I am writing to inquire as to your alleged purpose for doing so since I did not apply for employment with your organization nor did I request credit from your organization.

Based on the evidence in my possession, this inquiry was performed under false pretenses as described in the clear language of the law. 15 USC §1681n(a)(1)(B ) states, in part, "in the case of liability of a natural person for obtaining a consumer report under false pretenses or knowingly without a permissible purpose, actual damages sustained by the consumer as a result of the failure or $1,000, whichever is greater;"
 
You are civilly liable to me in the amount of $1,000.00 for your willful violation of the law -- performing a "hard inquiry" on my __________ file without my permission. I do hope that we can settle this matter amicably. You can remove the inquiry within one (1) business day of the receipt of this notice. Or, we can meet in court where you will end up removing the inquiry, paying me the civil liability fine, punitive damages for my score drop, plus court and attorney fees. The choice is up to you.

Sue without sending the pp letter first??? And if I do send the pp letter, should I list each time they pulled my report in the one letter or send 7 seperate letters? Thank you both so much for your help in this.

I would list every one that is showing on CR for all CRAs.  Keep hard copies of CR  it will be needed if at any time within 2 years,if you want to file suit

She would rather give them a chance to fix this first-
 
I think it's *&!@_$+@ to report a medical CA for such a small amount- becides I would like to see the 11th district back up PINTOS

Thank you. I will be very careful in documentation of my communications (which will be written only) with them and make copies of my current report just in case I need it later.

I was pretty upset to see 8 dings (the collection listing plus the 7 inquiries) to my report over such a small amount as well. It is very tempting to just sue because this seems kind of malicious in intent to me. Everything I read on here before posting only confirms my suspicion that NCO is the "debil." Smiley Wink
